RESOLUTION 63-187 APPROVING THE DECISION OF <br />THE PLANNING COMMISSION TO GRANT A VARIANCE <br />ON VARIANCE APPLICATION NO. 1813 FILED BY <br />WALTER W. COLE ANDMATRYCE H. COLE; OVERRULING <br />THE PLANNING COMMISSION'S DECISION TO EXCLUDE <br />THE SERVICE STATION PORTION FROM SAID VARIANCE <br />AND GRANTING SAID VARIANCE AS REQUESTED ON <br />APPLICATION NO. 1813, SUBJECT TO CONDITIONS <br /> <br /> WHEREAS, Variance Application No. 1813 was filed with the <br />City Planning Department requesting permission to construct a <br />shopping center and service station on R-1 property located between <br />Mountain View and Newhope Streets on the South side of West Fifth <br />Street, Santa Aha, California; and <br /> <br /> WHEREAS, after public hearing on notice, the Planning Commis- <br />sion granted said Variance but excluded the service station portion <br />of the applicant's request; and <br /> <br /> WHEREAS, Appeal Application No. 110 was duly filed by said <br />applicants appealing the decision of the Planning Commission to <br />exclude the service station fr~m said Variance and requesting a <br />hearing on said Variance before the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing on, notice, <br />has determined that the decision of the Planning Commission to <br />exclude the service station from the granting of Variance Application <br />No. 1813 should be overruled and that said variance should be granted <br />subject to conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana hereby approves the decision of the Planning <br />Co~amission to grant a variance on Variance Application No. 1813, <br />overrules the Planning Commission's decision to exclude the service <br />station portion from said Variance, and does hereby grant said <br />Variance as requested on Application No. 1813, subject to conditions <br />as follows: <br /> <br />1. That a minimum of 44 accessible and usable parking stalls on <br /> asphalt or concrete be provided on the applicant's property. <br /> <br />2. That all parking be 9' x 20' and be marked and have wheel stops. <br /> <br />e <br /> <br />That a 6-foot block wall be constructed along the applicant's <br /> south property line; and/or the south line of a 20-foot alley <br /> to the rear df the property in question. <br /> <br />That a detailed landscaping plan showing over-all treatment of <br /> the property, meaning type, size and placement of shrubs, <br /> grass and landscaping, be submitted to and approved by t'ne <br /> Planning Department prior to a utilities release. <br /> <br />5. That the following conditions be complied with prior to issuance <br /> of a building permit: <br /> <br />That the subdivider's engineer furnish the Department of <br />Public Works an on-site drainage flow plan showing the <br />direction and flow to adjacent streets when this property <br />is developed; <br /> <br />That the subdivider's engineer furnish the Department of <br />Public Works a final grading plan including existing <br />elevations along the property lines. <br /> <br />c. That the owner pay a drainage assessment fee of $415.00 <br /> per acre. <br /> <br />d. That the plot plan be revised so that driveways conform <br /> to the Municipal Code. <br /> <br /> <br />
