B-23-CP-CA-0109 <br />requirements of 2 CFR part 200, subpart E); a certification of <br />the costs; and the amounts and sources of other project funds. <br />4. A final performance report providing a comparison of actual <br />accomplishments with the objectives of the Project, the reasons for slippage <br />if established objectives were not met and additional pertinent <br />information including explanation of significant cost overruns. <br />5. A final property report, if specifically requested by HUD at the time of closeout. <br />ARTICLE VIII. Default <br />A default under this Grant Agreement shall consist of any use of Grant Funds for a purpose other <br />than as authorized by this Grant Agreement, any noncompliance with statutory, regulatory, or <br />other requirements applicable to the Grant Funds, any other material breach of this Grant <br />Agreement, or any material misrepresentation in the Grantee's submissions to HUD in <br />anticipation of this award. If the Grantee fails to comply with the terms and conditions of the <br />Grant Agreement, HUD may adjust specific conditions of this Grant Agreement as described in 2 <br />CFR part 200, as may be amended from time to time. If HUD determines that noncompliance <br />cannot be remedied by imposing additional conditions, HUD may take one or more of the <br />remedies for noncompliance described in 2 CFR part 200, as may be amended from time to time. <br />HUD may also terminate all or a part of this award as provided by 2 CFR 200.340 and other <br />applicable provisions of 2 CFR part 200, as may be amended from time to time. Nothing in this <br />Grant Agreement shall be construed as creating or justifying any claim against the Federal <br />government or the Grantee by any third party. <br />Page 9 <br />
