monetary gain or other compensation, or by reason of <br />engaging in business or activity for monetary gain or <br />other compensation. <br />Z. Excess Usage. If sick leave is used in excess of that <br />due and available to an employee, such excess sick leave <br />will, first, be deducted from any available compensatory <br />time off benefit; second, from any available vacation <br />leave benefit; finally, deducted from the next scheduled <br />wage or salary payment. <br />J. Personal Necessity Leave. Each employee shall be afforded <br />the opportunity to use sick leave benefits up to six (6) <br />days (48 hours for 40-hour workweek employees or six (6), <br />24--hour shifts (144 hours) for uniformed, "safety --member" <br />.personnel per calendar year (on a non -cumulative basis) <br />to attend to an illness of a child, parent, or spouse of <br />the employee. As used in this section: <br />1. "Child". means a biological, foster, or adopted child, <br />.a stepchild, a legal ward, or a child of a person <br />standing in loco parentis; <br />2. "Parent" means a biological, foster, or adoptive <br />parent, a stepparent, or a legal guardian. <br />Of the 48 and 144 hours, respectively, defined above, each <br />employee shall be afforded the opportunity to use up to <br />three (3) days (24 hours for 40-hour workweek employees or <br />three (3) 24-hour shifts (72 hours) for uniformed, "safety - <br />member" personnel per calendar year (on a non -cumulative <br />basis) for "personal necessity leave," which circumstances <br />shall be limited to serious accidents involving members of <br />the employee's immediate family, childbirth, medical or <br />dental appointments for members of the employee's household, <br />imminent danger to the employee's home or other valuable <br />property, or the existence of external circumstances beyond <br />the employee's control making it impractical for him or her <br />to report to duty. <br />K. Payment for Unused Sick Leave. <br />1. Payment criteria and limitations. <br />a. Upon nondisciplinary termination of employment <br />after ten (10) years cumulative full-time <br />service with the City, each qualified employee <br />with less than twenty-five (25) years of <br />cumulative full-time service with the City shall <br />be' entitled to payment for one --third (1/3) of <br />the total sick leave benefit credited to his or <br />her account upon the effective date of such <br />termination, not to exceed a maximum limit of <br />427 hours for employees working an eight (8) <br />32 <br />
