period" is extended after issuance for an <br />additional period, such additional period will be <br />deemed to be part of the "policy period" for <br />purposes of determining the applicable Limits of <br />Insurance and "self -insured retention". <br />SECTION N COMMERCIAL GENERAL LIABILITY <br />CONDITIONS <br />1. Bankruptcy <br />Your bankruptcy or insolvency, or the bankruptcy <br />of any other insured or of the insured's estate will <br />not relieve: <br />a. Us of our obligations under this Coverage <br />Part, or <br />b. You of your obligations to defend any claim or <br />"suit' against you or any other insured. <br />2. Duties In The Event Of Occurrence, Offense, <br />Claim Or Suit <br />a. Notice of Occurrence Or Offense <br />You or any insured must see to it that we are <br />notified as soon as practicable of an <br />"occurrence" or an offense which may result in <br />a claim. To the extent possible, notice should <br />include: <br />(1) How, when and where the "occurrence" or <br />offense took place; <br />(2) The names and addresses of any injured <br />persons and witnesses; and <br />(3) The nature and location of any injury or <br />damage arising out of the "occurrence' or <br />offense. <br />b. Notice Of Claim Or Suit <br />If a claim is made or "suit' is brought against <br />any insured, you or any insured must: <br />(1) Immediately record the specifics of the <br />Bairn or "suit" and the date received; and <br />(2) Notify us as soon as practicable if the <br />claim or "suit" is likely to exceed the "self - <br />Insured retention". <br />You or any insured must see to it that we <br />receive written notice of the claim or "suit" as <br />soon as practicable. <br />c. Assistance And Cooperation Of The <br />Insured <br />You and any other involved insured must: <br />(1) Immediately send us copies of any <br />demands, notices, summonses or legal <br />papers received in connection with the <br />claim or "suit" involving or likely to involve <br />a sum in excess of the "self -insured <br />retention"; <br />(2) Authorize us to obtain records and other <br />information; <br />Page 16 of 23 <br />(3) Cooperate with us in the investigation or <br />settlement of the claim or defense against <br />the "suit"; <br />(4) Assist us, upon our request, in the <br />enforcement of any right against any <br />person or organization which may be <br />liable to the insured because of injury or <br />damage to which this insurance or the <br />"self -insured retention" may also apply; <br />(5) Advise us of the name and address of <br />defense counsel retained to represent the <br />insured's interest with respect to the "self - <br />insured retention". Further, if the claim or <br />"suit", in our opinion, involves or is <br />reasonably likely to involve payment by us <br />under this Coverage Part, we shall require <br />you or the insured against whom a Claim <br />is made or'suit" is brought, to obtain our <br />written consent regarding the selection of <br />any defense counsel; <br />(6) Furnish us the following information: <br />(a) Quarterly loss runs identifying all <br />open and paid claims and "claim <br />expenses". Such loss runs shall be <br />furnished until all claims and "claim <br />expenses" are paid; <br />(b) Complete Information on all claims <br />reserved for 50% or more of the <br />amount of the "self -insured retention". <br />This information must be furnished <br />within 30 days from the date such <br />reserve is established; <br />(c) Complete information on all claims <br />(including multiple claims) arising out <br />of an 'occurrence" or offense which <br />might require payment in excess of <br />the 'self -insured retention'. This <br />information must be furnished within <br />30 days from the date such possibility <br />first arises; <br />(d) Complete information on any claim <br />arising out of an "oocurence" or <br />offense involving a minor child, or any <br />of the following injuries: <br />(i) Death, <br />(II) Quadriplegia, <br />(if!)
