AGREEMENT <br />THIS AGREEMENT made and entered into this 23rdday of _May____ <br />1973, by and between the City of Garden Grove" a municipal corporation, <br />hereinafter called "GARDEN GROVE" and the City of Santa Ana, a municipal <br />corporation, hereinafter called "SANTA ANA"- <br />NlTNE55ETH THAT: <br />WHEREAS, considerable traffic congestion presently exists and is <br />increasing at the intersection of Euclid Street at Westminster Avenue; <br />WHEREAS, a study has been completed and the conclusion drawn that traffic <br />conditions at the said intersection warrant the intersection to be included within <br />a progression system for the proper and orderly movement of traffic on Euclid <br />WHEREAS, portions of said intersection are within the City boundaries of <br />Santa Ana and of Garden Grove; <br />WHEREAS, it is the desire of the parties hereto to set out their <br />respective rights and obligations concerning the improvement, modification, <br />operation and maintenance of existing traffic signal and lighting system at the <br />intersection of Westminster Avenue and Euclid Street; <br />NOW THEREFORE, for and in consideration of the covenants herein contained, <br />performed and to be performed, the parties hereto agree as follows: <br />l' The parties hereto agree to share the engineering, administration, <br />construction and inspection costs of the installation of the traffic <br />signal modification in the same ratio as the number of legs under <br />each party's jurisdiction entering the intersaofionareto the total <br />number of legs entering the intersection. <br />2- The total cost of said modification project is presently estimated not <br />to exceed $41,500-00 and shall initially be borne by Garden Grove. <br />3' Following completion of construction, Santa Ana shall, upon receipt <br />of proper demand, reimburse Garden Grove in an amount equal to fifty <br />percent (50%) of the total eligible cost' Both Garden Grove and <br />Santa Ana plan to finance their share of the costs for this project <br />with TOPICS funds and City matching funds. It is mutually understood <br />that Santa Ana will only be required to finance that portion of this <br />project where TOPICS and City matching funds are eligible to be <br />jointly used. <br />-l- <br />
