L E A S E FOR EDNA PARK, SANTA ANA This lease, made and entered into this _LLIEttk, day of _m;&jLy_, 1975, by and between GARDEN GROVE SANITARY DISTRICT, hereinafter called "District", and the CITY OF SANTA ANA, hereinafter called "City". W I T N E S S E T H WHEREAS, City is planning development of a public park, to be known as Edna Park, at 2140 West Edna Drive, Santa Ana, also described as (See Exhibit A Attached) WHEREAS, park site described herein is being leased for a period of twenty-five (25) years by City from the Orange County Flood Control District; and WHEREAS, City desires to connect said park site to a public sewer; and WHEREAS, the only public sewer available to serve said park site belongs to District; and WHEREAS, annexation to District would involve the Orange County Flood Control District which is not interested in the process; and WHEREAS, District has, in special circumstances, permitted property not in the District to connect to District's sewer lines through lease agreements; and WHEREAS, Edna Park would not be added to the tax rolls even though annexed to District; and WHEREAS, annexation to District would involve out-of-pocket costs such as fees to the State Board of Equalization and to the Local Agency Formation Comm- ission and engineering fees for legal description and plat; and WHEREAS, District and City agree that their interests and that of their residents and taxpayers would best be served by connection of Edna Park to District's sewer line in Edna Street through lease agreement without annexation to District, NOW, THEREFORE, IT IS AGREED AS FOLLOWS- 1, That City be permitted to connect to District's sewer line in Edna Street the property described herein and referred to as Edna Park under terms of this lease. 2. That the term of this lease shall be for twenty-five (25) years, That City shall pay to District the sum of Ten Dollars ($10.00) per year
