In each case ' <br />the person so appointed shall hold office until the first Tuesday following <br />the next general municipal election and until his successor is elected and <br />quafifled for the remainder of an unexpired term. If the City Council <br />shell fell to fill · vacancy by appointment within thirty days after such <br />an ofllct shall hive become vacant, It shall forthwith cause an election <br />to be held to fill such vacancy. <br /> <br /> If a member OF the City Council absents himself from all regular <br />meetings of tho City Council for a period, of sixty days consecutively <br />from and after the lsat regular City Councd meeting attended by such <br />member, unless by permission of the City Council expressed In its official <br />minutes, or if a member is convicted of a crime involving moral turpi- <br />tude or shall cease to be a qualified elector of the City, his office shall <br />become vacant and shill be so declared by the City Council. <br /> <br /> Section 404. PRESIDING OFFICER. MAYOR. In the first meet- <br />ing of the City Council following any general or special election at <br />which members of the City Council are elected, the City Council shall <br />elect one of its members as presiding off]car who shall hav.e, the title of <br />Mayor. The Mayor shill have voice sad vain in all of the C:ty Council's <br />proceedings and shill bo recognized as hesd of the City government for <br />all ceremonial purposes. The Mayor shall have no administrative duties <br />but shall perform such other duties as may be prescribed by th~s <br />Charter, or imposed by the City Council, consistent with his office. The <br />Mayor shall serve in his capacity as Mayor at the pleasure of the City <br />Council. <br /> <br /> Section 405. CITY COUNCIL: ACTING MAYOR. VICE MAYOR. <br />In the first meeting of the City Council following any general or special <br />election at which members of the City Council are elected, the City <br />Council shill elect a Vise Msyor who shill act as Mayor during the <br />absence from the City or disability of the M~yor. <br /> <br /> Section 406. CITY COUNCIL: JUDGE OF ELECTIONS AND QUAL- <br />IFICATIONS OF MEMBERS. The City Council shall be the judge of the <br />election and qualifications of its members as defined in Section 401 of <br />this Article and shill meet on the first Tuesday after any municipsl <br />election at which members of the City Council are elected, duly canvass <br />the returns and declare the results thereof, and install elected members, <br />If any. <br /> <br /> Section 407. CITY COUNCIL: POWERS AND DUTIES. All powers <br />of the City sad the determination of all matters of policy shall be vested <br />in the City Council, subject to the provisions of this Charter end to the <br />Constitution of the State of California. <br /> <br /> Section 408. CITY COUNCIL: INTERFERENCE IN ADMINISTRA- <br />TIVE MATTERS. Except for the purpose of inquiry, the City Council <br />and its members shsti deal with thu administrative branch of the City <br />government solely through the City Manager or hls designated deputy, <br />and neither the City Council nor any member thereof shall give orders <br />to any subordinates of the City Manager, either publicly or privately. <br /> <br /> <br />
