RECITALS A. The City desires to retain a consultant having special sldll and knowledge in the field of industrial hygiene testing. B. Consultant represents that Consultant is able and willing to provide Such services to the City. C. In undertaking the performance of this Agreement, Consultant represents that it is knowledgeable in its field and that any services performed by Consultant under this Agreement will be perfon-ned in compliance with such standards as may reasonably be expected from a professional consulting firm in the field. NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the terms and conditions hereinafter set forth, the parties agree as follows: I. SCOPE OF SERVICES Consultant shall perform an indoor air quality investigation of the animal care shelter as detailed in Exhibit A to this Agreement and provide on call services. 2. COMPENSATION a. City agrees to pay, and Consultant agrees to accept as total payment for its services, the rates and charges identified in Exhibit A for the air quality study and the following rates for on -call services: Expert field, preparation and research time $350.00 per hour Expert deposition and Court testimony $450.00 per hour Senior hidustrial Hygienist $175.00 per hour Industrial Hygienist $125.00 per hour Word Processor $40.00 per hour Mileage $.40 per mile The total sum to be expended Linder this Agreement shall not exceed $ 10,000.00 during the term of this Agreement.
