A-2003-078 AMENDMENT 'f TO AGREEMENT THIS AMENDMENT, made and entered into this day of April, 2003, by and between Intergraph Inc. ("ConSU]tant") and the City of Santa Ana, a charter city and municipal corporation duly organized and existing under the Constitution and laws of the State of California ("City"), collectively referred to herein as "the Parties". RE-CIIALS A. The Parties entered into that certain agreement entitled "Software Maintenance Service and Multi vendor Service Contract" dated May 1, 2002, hereinafter referred to as "said Agreement", for the provision of software and hardware maintenance to City computerized systems; B. The Parties hereto now desire to amend the Compensation and Period of Performance of said Agreement in order to provide continuous, uninterrupted service under the Agreement. WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter contained and made, and subject to all of the terms and conditions of said Agreement as hereby aniendcd, the parties hereto do hereby agree as follows: I. The "Compensation" terin of said Agreement is hereby amended to provide an amount not to exceed $60,000.00 per year, 2. The "Period of Performance" term of said Agreement is hereby amended to extend the term until May 1, 2004, with a one year option to renew upon approval of the Executive Director of the Public Works Agency Pursuant to request for council action dated 04-21-2003, 3. Except as hereinabovc modified, the tern -is and conditions of said Agreement remain unchanged and in full force and effect.
