EIGHTH AMENDMENT TO LEGAL SERVICES AGREEMENT BETWEEN THE CITY OF SANTA ANA AND KINKLE, RODIGER & SPRIGGS This Amendment, made and entered into this 21 st day of November 2006, by and between the City of Santa Ana, a charter city and municipal corporation, duly organized and existing Linder the Constitution and laws of the State of California ("City") and Kinkle, Rodigcr & Spriggs, a professional corporation ("Attorneys"). WlTNESSETH A. The parties hereto entered into a certain agreement dated August 2, 1976, as amended on May 7, 1979, January 21, 1985, January 19, 1988, March 20, 1989, October 19, 1992, July 1, 1999 and January 5, 2004 hereinafter referred to as "said agreement as amended,"" for the purpose of employing Attorneys to assist the City Attorney in the defense of actions for damages against City, its agencies, officers and employees. B. The parties desire to amend the fee schedule of said agreement as amended. WHEREFORE, in consideration ofthe respective and mutual covenants and promises hereinafter contained and made, and subject to all the terms and conditions hereof., the parties hereto do hereby agree as follows: I. It is hereby agreed by the parties hereto that effective November 21, 2006, Paragraph B of said agreement as amended, is modified to read as follows: B. Payment for Services Rendered "City agrees to pay Attorneys, and Attorneys agree to accept from City, as and for payment in full of said services, determined as follows: $175.00 per, hour." 2. Except as specifically modified hereby, all of the terms, conditions and covenants of said agreement dated October 19,1992, shall remain in frill force and effect, and the parties shall continue to benefit from and be bound thereby.
