m V4 A VE D C L i" 11"K U E SIXTH AMENDMENT TO LEGAL SERVICES AGREEMENT BETWEEN THE CITY OF SANTA ANA AND KINKLE, RODIGER & SPRIGGS This Amendment, made and entered into this I" day of July 1999, by and between the City of Santa Ana, a charter city and municipal corporation, duly organized and existing tinder the Constitution and laws of the State of California ("City") and Kinkle, Rodiger & Spriggs, a Z-11 professional corporation ("Attorneys") WITNESSETH A. The parties hereto entered into a certain agreement dated August 2,1976, as amended on May 7, 1979, January 21, 1985, January 19, 1988, March 20, 1989 and October 19, 1992, hereinafter referred to as "said agreement as amended," for the purpose of employing Attorneys to assist the City Attorney in the defense of actions for damages against City, its agencies, officers and employees. B. The parties desire to amend the fee schedule of said agreement as amended. WHEREFORE, in consideration of the respective and mutual covenants and promises hereinafter contained and made, and subject to all the teri-ris and conditions hereof, the parties hereto do hereby agree as follows: 1. It is hereby agreed by the parties hereto that effective July 1, 1999, Paragraph B of said agreement as amended, is modified to read as follows: B. Payment for Services Rendered "City agrees to pay Attorneys, and Attorneys agree to accept from City, as and for payment in full of said services, determined as follows: $125.00 per hour." 2. Except as specifically modified hereby, all of the terms, conditions and covenants of said agreement dated October 19,1992, shall remain in full force and effect, and the parties shall continue to benefit from and be bound thereby.
