DBA The Solis Group for Labor Compliance and <br />Community Workforce Agreement Professional Administration Services (Non -General <br />Fund) (RFP #24-084) <br />RECOMMENDED ACTION <br />Authorize the City Manager to execute an agreement with The Solis Group for <br />Community Workforce Agreement professional administration services to provide <br />professional services in overseeing and monitoring labor compliance requirements, for a <br />three-year term beginning September 17, 2024 and expiring on September 16, 2027, <br />with the provision for one, two-year extension, in an amount not to exceed $2,000,000 <br />(Agreement No. A-2024-XXX). <br />GOVERNMENT CODE §84308 APPLIES: Yes <br />DISCUSSION <br />The Public Works Agency (PWA)'s Engineering Services Division is responsible for the <br />administration and oversight of all Capital Improvement Projects in the city. On June 19, <br />2024, PWA released Request for Proposal (RFP) No. 24-084 to select one firm to <br />provide professional services in overseeing and monitoring labor compliance <br />requirements for the City of Santa Ana PWA Engineering Division (Exhibit 1). These <br />services are required to ensure that any and all Contractors adhere to the State of <br />California Department of Industrial Relations (DIR) Labor Compliance, Prevailing Wage <br />requirements and compliance with the City's Community Workforce Agreement (CWA). <br />All workers performing any labor on construction projects must be in accordance with <br />the California State Labor Code. <br />On June 6, 2023, the City Council approved the Community Workforce Agreement <br />(CWA) with the Los Angeles / Orange Counties Building and Construction Trades <br />Council and the Signatory Craft Councils and Unions. Generally, the CWA requires that <br />a contractor on covered projects utilize a specified number of "skilled and trained <br />workforce." This requirement is satisfied by hiring workers through a union hiring hall. <br />
