Bristol St.) <br />and Staff Resolution Modifying Parking Districts in the Surrounding Area <br />September 17, 2024 <br />Page 5 <br />During the public hearing, a total of 29 individuals provided comments on the project. Of <br />the 29 comments, 18 were in support, one (1) was in opposition, and 10 expressed no <br />clear position. The nature of the comments in support centered on the project's <br />proposed improvements and contributions to the community, while those in opposition <br />or with no clearly stated position centered on concerns about density, open space, <br />traffic, parking, and oversight of how the DA's $22 million community benefit payment <br />would be spent. <br />Additional Clarifications and Refinements <br />Subsequent to the August 12t" Planning Commission hearing, the Applicant requested <br />two refinements to the Development Agreement that further clarify certain issues within <br />the Development Agreement. <br />The first refinement is responsive to the Commission's provision regarding the <br />applicability of the inclusionary housing requirements to the senior continuum of care <br />component of the Development Agreement. The Agreement has been refined to clearly <br />state that the inclusionary housing ordinance does not exempt age -restricted or senior <br />residential housing from meeting affordability requirements and should the applicant <br />wish to convert the senior continuum of care units to residential units, these units would <br />be subject to the inclusionary housing requirements under the Agreement and would be <br />required to pay the $5 per square foot of habitable residential area in -lieu fee. <br />The Second refinement is for the purpose of advancing the development of the open <br />space on the Project Site. The Applicant is proposing to refine the Agreement to clarify <br />and provide the applicant the ability for early development of the open space proposed <br />in Phase III as part of an earlier Phase (i.e. Phase II) without triggering the payment of <br />the final $8 million community benefit payment. The refinement is a positive investment <br />and further commits the applicant to completing the project. <br />Both refinements do not modify the substance of the Agreement as recommended by <br />the Planning Commission and have been included in the draft Development Agreement <br />attached as Exhibit 8.
