A-2001-0 13 <br />(jj C <br />FIRST AMENDMENT TO CONSULTANT AGREEMENT <br />THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is made and entered <br />into this � day of 2001, by and between the CITY OF <br />SANTA ANA, a charter city and murn4al corporation of the State of California, <br />("City") and M.A. FRANCIS & ASSOCIATES, INC., ("Consultant"). <br />RECITALS: <br />A. City and Consultant entered into an agreement dated April 3, 2000 ("Agreement") by <br />which Consultant agreed to analyze City's existing generator and prepare <br />construction documents and provide construction oversight for the construction of a <br />new generator and enclosure at City Hall. <br />B. City has awarded a contract to build anew City Hall Emergency Generator and <br />Consultant has agreed to provide construction inspection services during the project. <br />WHEREFORE, in consideration of the mutual and respective covenants and promises <br />contained in the Agreement, and subject to all of the terms and conditions of the <br />Agreement, except those amended in this First Amendment to Consultant Agreement, <br />City and Consultant agree as follows: <br />Consultant shall provide electrical and plumbing inspection services during the <br />construction of the City Hall Emergency Generator, as spccificd in Consultant's <br />letter dated December 8, 2000, identified as Exhibit "A- I ", attached hereto and <br />incorporated herein. <br />2. City agrees to pay and Consultant agrees to accept as total payment for its <br />services, the fees set forth in its letter "A -I". <br />Total compensation paid to Consultant pursuant to the Agreement and this First <br />Amendment to Consultant Agreement shall not exceed FIFTY THOUSAND <br />DOLLARS ($50,000.00). <br />4. The term of the Agreement shall be extended to terminate February 28, 2002. <br />The term of the Agreement may be further extended upon a writing executed by <br />the Executive Director of the Public Works Agency and the City Attorney. <br />
