amount not to exceed Thirteen Thousand Dollars ($13,000.00). Consultant's hourly rate is Fifty -Five Dollars ($55.00) per hour. Payment by City shall be made within 30 days of receipt of a proper invoice directed to the Building Maintenance Superintendent evidencing work performed. Notwithstanding the foregoing, payment need not be made for work which fails to meet the standards of performance which may reasonably be expected by City of Consultant. 5. Termination of Agreement This Agreement shall continue for the contract period until terminated. Either party may terminate this Agreement upon thirty (30) days written notice of termination on the other party. The Executive Director is authorized to terminate this Agreement on behalf of the City. 6. Independent Contractor Consultant is an independent contractor and not an employee of the City, and all of Consultant's personnel shall be employees or subcontractors of Consultant, and not employees of the City. Consultant shall pay all salaries and wages, employer's Social Security taxes, unemployment insurance and similar taxes relating to employees, and shall be responsible for all applicable withholding. 7. Insurance/Permits a. If Consultant now, or at any time during the contract period, qualifies as an employer under the California Labor Code, Consultant shall furnish City with an insurance certificate evidencing that it carries workers' compensation insurance as required by law. b. Based on the advisory capacity in which Consultant shall serve, City's general insurance requirements shall be waived. C. Should any of Consultant's plans/drawings be implemented directly, all required permits shall be secured through the Building Maintenance Superintendent. S.
