amount not to exceed Thirteen Thousand Dollars ($13,000.00). Consultant's hourly rate <br />is Fifty -Five Dollars ($55.00) per hour. <br />Payment by City shall be made within 30 days of receipt of a proper invoice directed to <br />the Building Maintenance Superintendent evidencing work performed. Notwithstanding <br />the foregoing, payment need not be made for work which fails to meet the standards of <br />performance which may reasonably be expected by City of Consultant. <br />5. Termination of Agreement <br />This Agreement shall continue for the contract period until terminated. Either party may <br />terminate this Agreement upon thirty (30) days written notice of termination on the other <br />party. The Executive Director is authorized to terminate this Agreement on behalf of the <br />City. <br />6. Independent Contractor <br />Consultant is an independent contractor and not an employee of the City, and all of <br />Consultant's personnel shall be employees or subcontractors of Consultant, and not <br />employees of the City. Consultant shall pay all salaries and wages, employer's Social <br />Security taxes, unemployment insurance and similar taxes relating to employees, and <br />shall be responsible for all applicable withholding. <br />7. Insurance/Permits <br />a. If Consultant now, or at any time during the contract period, qualifies as an <br />employer under the California Labor Code, Consultant shall furnish City with an <br />insurance certificate evidencing that it carries workers' compensation insurance as <br />required by law. <br />b. Based on the advisory capacity in which Consultant shall serve, City's general <br />insurance requirements shall be waived. <br />C. Should any of Consultant's plans/drawings be implemented directly, all required <br />permits shall be secured through the Building Maintenance Superintendent. <br />S.
