C <br />�(E E <br />A Y Pf! 0 1 "1 D EJC: jd( 30 <br />7/18/90 <br />AGREEMENT BETWEEN THE CITY OF SAD NTA ANA ANTHE <br />rc KIWANIS CLUB OF SANTA ANA FOR THE DEVELOPMENT OF <br />A "BARRIER FREE PARK" IN THORNTON PARK <br />THIS AGREEMENT, made and entered into this day of <br />between the City of Santa Ana, <br />Y-2. — <br />1990, by and <br />a municipal. corporation of the State of California, hereinafter <br />referred to as "CITY," and the the Kiwanis Club of Santa Ana, a <br />nonprofit service organization, hereinafter referred to as "KIWANIS," <br />Olooses <br />W I T N E S S E T H <br />l® CITY owns, operates and maintains for the public's <br />benefit a 30 acre park, known as Thornton Park, 1801 Segerstrom <br />Avenue, Santa Ana, California (hereinafter referred to as "Park"). <br />2. KTWNNIS desire to contribute through fund raising <br />or similar activities for the development of a "barrier free" park <br />within Thorn -ton Park. <br />3. CITY and KIWANIS desire to cooperate and coordinate <br />their respective efforts to the greater benefit of the community <br />by providing a "barrier free park/facility" within the City, to be <br />enjoyed by all residents in the City. <br />WHEREFORE, for and in consideration of their mutual cov- <br />enants and agreements hereinafter set forth, and subject to the <br />terms, conditions, limitations and other provisions of this agree- <br />ment, hereinafter set forth, the parties agree as follows: <br />I. CITY RESPONSIBILITY <br />CITY shall prepare a master plan for a handicap facility, <br />identifying locations for restrooms/recreat ion room, camping area, <br />
