RESOLUTION NO. 61-206 AUTHORIZING CONDEMNATION OF <br />CERTAIN REAL PROPERTY FOR THE PURPOSE OF EXTENDING <br />THE CITY SEWER SYSTEM ON THE EAST SIDE OF TUSTIN <br />AVENUE, NORTH OF FIRST STREET, AND DECLARING THE <br />NECESSITY THEREFOR <br /> <br /> WHEREAS, in order to provide satisfactory municipal services <br />to a certain area annexed to the City of Santa Ana that is presently <br />without sanitary sewers, it has been determined that said sewers need <br />be installed along the East side of Tustin Avenue, North of First <br />Street; and <br /> <br /> WHEREAS, it is necessary that the City obtain an easement for <br />sewer purposes along said East side of Tustin Avenue, North of First <br />Street, in order to install adequate sewer facilities. <br /> <br />NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br /> <br />City of Santa Aha does hereby find and determine that the public <br /> <br />interest and necessity require that said sewer system be installed <br /> <br />and improved, and further require that said City do have, take and <br /> <br />acquire an easement for sewer purposes over, under, through and across <br /> <br />certain lands in the City of Santa Ana, County of Orange, State of <br /> <br />California, described as: <br /> <br />The Westerly 40.00 feet of the following described property: <br /> <br />Commencing at the Southwest corner of land owned by W. B. <br />Wall in the center of the highway known as the Newport Road; <br />thence South along the center of said highway ten chains <br />and~xty-eight and three-fourths links; thence East eight <br />chains and eighty-nine and one-half links; thence North <br />ten chains and sixty-eight and three-fourths links; thence <br />West eight chains and eighty-nine and one-half links to the <br />place of beginning, said tract containing nine and one-half <br />acres of land, more or less, and being a part of the Felipe <br />Yorba Tract of land partitioned to him by decree of court <br />September 12, 1868. <br /> <br />Excepting therefrom that portion of said 40.00 feet previously <br />dedicated for street purposes. <br /> <br /> BE IT FURTHER RESOLVED: That the public interest, necessity <br />and convenience require, and it is hereby ordered, that the City of <br />Santa Ana, a municipal corporation, Plaintiff in the condemnation action <br /> <br />-1- <br /> <br /> <br />
