RESOLUTION NO. 61-20~ GRANTING APPEAL APPLICATION NO. 34 BY RUSSELL D. SHIELDS WHERE ZONING ADMINIS- TRATOR DENIED VARIANCE WHEREAS, RUSSELL D. SHIELDS filed Variance Appeal Application No. 34 which was denied by the Zoning Administrator and came on for hearing before the City Council. '~ .' NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha finds exceptional circumstances applying to the subject property; that to preserve the enjoyment of substantial property rights possessed by other property in the same vicinity and zone this Variance should be granted; that such granting will not be materially detrimental to the public welfare or injurious to other property in the vicinity, nor adversely affect the general plan of the City, and that said Variance to permit building a duplex in the rear of the single family dwelling in an R-2 District on the property located at 706 South Birch Street, Santa Ana, California, all in accordance with the Variance Application filed is hereby granted upon the following conditions: 1. That owner construct standard full-width alley improvements across the width of the property involved in this application. 2. That all engineering for above improvements be done by owner's engineer and submitted to and approved by the Department of Public Works. 3. That all the above conditions be complied with prior to the issuance of utility releases by the Building Department.
