RESOLUTION NO. 61-214 RESCINDING THAT PORTION OF <br />RESOLUTION NO. 61-192 WHEREIN A DEED FOR STREET <br />RIGHT OF WAY OVER THREE PARCELS OF REAL PROPERTY <br />WAS ACCEPTED, AND ACCEPTING A CORRECTED DEED FOR <br />SAME SAID THREE PARCELS. <br /> <br /> WHEREAS, heretofore, the City of Santa Aha entered into Escrow <br />Number 390820-LFM at the Orange County Title Company for the purchase <br />of certain real property and deposited in said Escrow the agreed <br />purchase price; and <br /> <br /> WHEREAS, ANTONE and ANNA A. BORCHARD presented to the City two <br />deeds dated June 19, 1961, one granting a parcel of real property <br />containing 24.50 acres, more or less; and the other conveying an ease- <br />ment for street purposes over three parcels of real property; and <br /> <br /> WHEREAS, said deeds were duly accepted by the City by Resolu- <br />tion No. 61-192; and <br /> <br /> WHEREAS, said deed dated June 19, 1961, conveying the easement <br />for street purposes contained a material error in description and was <br />defective; and <br /> <br /> WHEREAS, ANTONE BORCHARD and ANNA A. BORCHARD have presented to <br />the City a corrected deed dated August 20, 1961, conveying an easement <br />for street purposes over the aforesaid three parcels of real property. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That that portion of Resolution <br />No. 61-192,wherein the defective deed dated June 19, 1961, conveying <br />the easement for street purposes over the said three parcels of real <br />property was accepted, is hereby rescinded. <br /> <br /> BE IT FURTHER RESOLVE~: That the City accepts said deed from <br />ANTONE BORCHARD and ANNA A. BORCHARD dated August 20, 1961, and <br />authorizes H. H. Foreman to execute such acceptance on the face of <br />said deed as the officer of the City thereunto duly authorized. <br /> <br />-1- <br /> <br /> <br />
