reduce the actual or perceived risk of planning for and proceeding with <br />development of the Project. <br />E. On August 12, 2024, the Planning Commission of the City of Santa Ana <br />held a duly -noticed public hearing on the proposed Development <br />Agreement No. 2023-02, recommending City Council approval of <br />Development Agreement No. 2023-02. <br />F. Entering into this Development Agreement No. 2023-02 would provide the <br />City with extraordinary and significant benefits that are of regional <br />significance, relate to existing deficiencies in public facilities, require the <br />Property Owners to contribute a greater percentage of benefits than would <br />otherwise be required, and represent benefits which would not otherwise <br />be required as part of the development process. <br />G. The Project and the use that the Property Owners propose in connection <br />with the Project have been extensively reviewed and considered by the <br />City Council, and such proposed development and use have been found <br />to accommodate the City's recommendations and suggestions in order to <br />protect the public's interest to enhance the desirability of such proposed <br />development and use. The terms and conditions of this Development <br />Agreement No. 2023-02 are fair, just and reasonable, and the City Council <br />has concluded that the pursuit of the Project will serve the interests of the <br />City. <br />H. Based on the entire record before the City Council and all written and oral <br />evidence presented, the City Council finds the Development Agreement <br />No. 2023-02 in the public's interest and results in substantial community <br />benefits because it meets and facilitates the fulfillment of many of the <br />City's adopted General Plan "Issues, Goals and Policies" for each <br />individual element, as further documented in the Ordinance of the City <br />Council approving Amendment Application No. 2023-03 to establish the <br />Related Bristol Specific Plan (SP No. 5) and approve the Zone Change. <br />Section 2. The City prepared a Draft Supplemental Environmental Impact <br />Report ("SEIR") that analyzed the Project's environmental impacts in accord with the <br />California Environmental Quality Act (Public Resources Code, §§ 21000 et seq., <br />"CEQA"), the regulations promulgated thereunder (14 Cal. Code of Regulations, <br />§§ 15000 et seq., the "CEQA Guidelines"), and the City's Local CEQA Guidelines. The <br />Draft SEIR was made available for public review for 45 days between July 6, 2023 and <br />August 21, 2023. The document was made available online at the City of Santa Ana <br />website and available for review at City Hall and the City of Santa Ana Public Library in <br />hard copy form. In response to comments received on the Draft SEIR, the City prepared <br />a Final SEIR and released it to the public on August 1, 2024. The Final SEIR in the City <br />Council Resolution approving the Final SEIR is incorporated herein by reference. The <br />City Council Resolution recommends certification of the Final SEIR (SCH No. <br />2020029087), adoption of findings under CEQA, and adoption of the Mitigation <br />Ordinance No. NS- <br />Page 2 of 5 <br />55394.00062\42643158.1 <br />
