RESOLUTION NO. 61-293 GRANTING VARIANCE NO. 1568 <br />ON APPEAL APPLICATION NO. 50 FILED BY EDWIN R. <br />WELLINGTON IV <br /> <br /> WHEREAS, after hearing on notice, the Zoning Administrator <br />denied a Variance on Variance Application No. 1568, filed by EDWIN <br />R. WELLINGTON IV, which said Variance was requested to build a new <br />retail market building in the R-1 District; and <br /> <br /> WHEREAS, Appeal Application No. 50 was duly filed with the <br />City Council appealing the denial of the Variance by the Zoning <br />Administrator; and <br /> <br /> WHEREAS, after hearing before the City Council; after careful <br />consideration of the statements contained in and the materials <br /> <br />accompanying the application; the testimony offered at the hearing; <br /> <br />examination of all the facts established; and after determining that <br /> <br />the use applied for by the Variance Application meets the requirements <br /> <br />of Section 9250.8 of the Santa Ana Municipal Code, it has been <br /> <br />determined that the Variance should be granted, subject to certain <br /> <br />conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana hereby grants Appeal Application No. 50 and grants <br />a Variance on Variance Application No. 1568 to permit the construction <br />of a new retail market at 1190 South Sullivan Street in the R-1 <br />District, subject to conditions as follows: <br /> <br />1. That the owner dedicate to the City a property line <br /> spandrel with a 25-foot radius at the corner of Sullivan <br /> and McFadden Streets. <br /> <br />2. That the owner dedicate to the City of Santa Ana all <br /> vehicular access rights from this property to McFadden <br /> Street. NOTE: Access can be determined and approved <br /> prior to dedication. <br /> <br />-1- <br /> <br /> <br />
