Div. <br />2 7 35 10 <br /> <br />San Diego Municipal Code Chapter 2: Government <br />(4-2019) <br /> <br /> <br /> <br />§27.3525 Exceptions to Restrictions on Benefits <br />(a) All exceptions relating to gifts, loans, honoraria, and travel expenses <br />contained in the Political Reform Act of 1974, as amended, including but not <br />limited to California Government Code sections 82028 and 89501 through <br />89506, and the regulations of the California Fair Political Practices <br />Commission, as amended, including but not limited to Regulations 18930 <br />through 18961, are hereby adopted by reference and incorporated into the City <br />of San Diego Ethics Ordinance as if fully set forth herein. <br /> <br />(b) For purposes of subsection (a), any exception not applicable to a gift, loan, <br />honorarium, or travel expense from a lobbyist, lobbying firm, or lobbyist <br />employer registered with the State of California shall also not apply to a gift, <br />loan, honorarium, or travel expense from a lobbyist, lobbying firm, or <br />organization lobbyist registered with the City. <br />(“Exceptions to Restrictions on Benefits” added 4-29-2002 by O-19055 N.S.) <br />(Amended 10-15-2013 by O-20302 N.S.; effective 11-14-2013.) <br /> <br />§27.3530 Loans as Gifts <br /> <br />(a) A loan received by a City Official may become a gift and subject to the gift <br />reporting and limitations set forth in section 27.3520, as follows: <br /> <br />(1) If the loan has a defined date or dates for repayment and has not been <br />repaid, the loan will become a gift when the statute of limitations for <br />filing an action for default has expired; or <br /> <br />(2) If the loan has no defined date or dates for repayment, the loan will <br />become a gift if it remains unpaid when one year has elapsed from the <br />later of: <br /> <br /> A. The date the loan was made; or <br />B. The date the last payment of $100 or more was made on the <br />loan; or <br />C. The date upon which the City Official has made payments <br />aggregating to less than $250 during the previous twelve <br />months. <br /> <br />
