RESOLUTION NO. 2023-082 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING A ONE-YEAR EXTENSION OF <br />SITE PLAN REVIEW NO. 2016-03, VARIANCE NO. 2017- <br />05, AND VARIANCE NO. 2017-06 FOR THE MADISON <br />MIXED -USE DEVELOPMENT TO BE LOCATED AT 200 <br />NORTH CABRILLO PARK DRIVE <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. On June 5, 2018, the City Council approved Appeal No. 2017-05, thereby <br />reversing the Planning Commission's decision to deny Site Plan Review No. <br />2016-03, Variance No. 2017-05, and Variance No. 2017-06 to allow the <br />development of a seven -story, 260-unit mixed -use development at 200 North <br />Cabrillo Park Drive. <br />B. Pursuant to City of Santa Ana Municipal Code Section 41-647, where <br />construction does not commence, these types of entitlements expire after two <br />(2) years unless the applicant applies for, and the City Council approves, an <br />extension. Up to three extensions may be granted. <br />C. Prior to the expiration of the subject entitlements, a state of local emergency <br />was declared stemming from the COVID-19 pandemic. Successive executive <br />orders extended the expiration date of the project's entitlements from June 5, <br />2020, to December 31, 2022. <br />D. Taking into consideration the difficulties experienced by the development <br />industry from the global COVID-19 pandemic and its effects on securing <br />funding, labor, and construction materials, the City Council approved the <br />applicants first request for a one-year entitlement extension on December 6, <br />2022, extending the subject projects entitlements until December 31, 2023. <br />E. Recent increases in interest rates beginning the first quarter of 2022 and <br />continuing through 2023, and their impact on construction loans and land <br />development costs, have resulted in additional delays to the project's ability to <br />complete the plan check process, pull permits, and break ground on the <br />project by the December 31, 2023, deadline. <br />F. It is the Planning Division's policy to recommend no more than one-year <br />extension at a time, mainly in an effort to encourage the construction of <br />previous approved projects. <br />Resolution No. 2023-082 <br />Page 1 of 4 <br />
