***********SURPLUS LINES NOTICE *********** <br />The coverage as stated above is being bound on a surplus lines -non admitted basis. As a condition of binding <br />the above coverage, the broker/agent warrants the following: <br />1) The broker/agent holds the surplus lines license in the state where coverage will be provided to the <br />Insured, and accepts the full obligation to comply with each state's surplus lines laws and regulations in <br />conjunction with this transaction. <br />2) The broker/agent accepts full responsibility for compliance, including but not limited to, the filing of the <br />surplus lines affidavit (as per the state's requirements), and the collection and remittance of the surplus lines <br />tax and any applicable stamping fee on 100% of the premium of this policy. The broker/agent's acceptance of <br />these requirements is to be confirmed by completing, signing and dating the attached Surplus Lines Filings <br />Confirmation form. <br />The above is subject to our receipt and satisfactory review of the following information: <br />1) Signed/Dated/Completed Supplemental Applications <br />2) Underlying carrier(s) must be rated A- VII or better by Best's, where applicable <br />3) Receipt of the completed and signed Surplus Lines Tax Filing Confirmation form warranting that the <br />broker/agent will accept full responsibility for compliance of the Surplus Lines laws and the collection and <br />remittance of the applicable surplus lines tax and/or stamping fees on 100% of the premium, must be received <br />within 10 days of binding. If the Surplus Lines Filing Confirmation form is not received within 10 days, we reserve <br />the right to cancel the binder and/or any policy issued in connection with the binder. <br />Standard Terms and Conditions; <br />1. As part of the terms and conditions of your policy, Starr Surplus Lines Insurance Company may <br />perform an Environmental Risk Assessment (ERA) or other type of Loss Control Survey during <br />the policy period. All surveys will be at Starr Surplus Lines Insurance Company cost. Adequate <br />coordination and scheduling will be arranged between the Wholesaler and the Insured prior to the <br />visit. <br />2. If an Additional Insured Endorsement is used on our policy please note the following wording: <br />a. Due to the varying terms required by certificate holders, the obstacles when attempting to <br />include contract language via a certificate of insurance and the difficulties involved when <br />enforcing these requirements, Starr Surplus Lines Insurance Company will not require <br />copies of certificates of insurance on behalf of the named insured. Insureds are advised <br />that certificates of insurance should be used only to provide evidence of insurance in lieu <br />of an actual copy of the applicable insurance policy. Certificates cannot be used to <br />amend, expand, or otherwise alter the terms of the actual policy. <br />Important: In order to complete the underwriting process, we require that you send us the additional <br />information requested at the beginning of the letter. We are not required to bind coverage prior to our <br />receipt, review and underwriting approval of the above information. However, if we do bind coverage prior <br />to such approval, it shall be for a period of not more than 10 days. Such binding of coverage shall be void <br />ab initio ("from the beginning") if we have not received, reviewed and approved in writing such materials <br />within 10 days from the effective date of the binder. Payment of premium shall not operate to extend the <br />binding period or nullify the automatic voiding as described above. <br />
