<br /> <br /> EMPG Program Appendix | February 2021 Page H-23 <br />When a grant-funded property is no longer needed for the originally authorized purpose, the recipient or <br />subrecipient (through the pass-through entity) must obtain disposition instructions from the cognizant <br />FEMA Regional Administrator or the pass-through entity. <br /> <br />Construction of Communication Towers <br />When applying for funds to construct communication towers, recipients and subrecipients must submit <br />evidence that the Federal Communication Commission’s (FCC) Section 106 review process has been <br />completed and submit all documentation resulting from that review to FEMA prior to submitting materials <br />for EHP review. <br /> <br />Davis-Bacon Act Compliance <br />EMPG Program recipients using funds for construction projects must comply with the Davis-Bacon Act and <br />subsequent legislation (40 U.S.C. §§ 3141 et seq.). See 42 U.S.C. § 5196(j)(9). Grant recipients must ensure <br />that their contractors or subcontractors for construction projects pay workers no less than the prevailing <br />wages for laborers and mechanics employed on projects of a character similar to the contract work in the <br />civil subdivision of the state in which the work is to be performed. Additional information regarding <br />compliance with the Davis-Bacon Act, including Department of Labor (DOL) wage determinations, is <br />available at https://www.dol.gov/whd/govcontracts/dbra.htm. <br /> <br />Acquisition of Real Property <br />Acquisition of real property is permissible if such property is needed to support other allowable program <br />costs or activities. <br /> <br />Advance Approval Requirement <br />Consistent with the requirements outlined above regarding construction activities, recipients and <br />subrecipients (through the pass-through entity) must obtain advance written approval from the cognizant <br />FEMA Regional Administrator prior to obligating annual EMPG Program funds for acquisition of real <br />property. Additionally, in cases of acquisition or improving real property, recipients are required to submit a <br />SF-429-B, Real Property Status Report, Attachment B providing details of the relevant property to be <br />acquired. <br /> <br />Property Use, Reporting, and Disposition Requirements <br />The acquisition, use, and disposition of real property shall be subject to the provisions of 2 C.F.R. Part 200. <br />In accordance with 2 C.F.R. Part 200, recipients and subrecipients are required to report on the status of the <br />acquired property on an annual basis using SF-429-A Real Property Status Report, Attachment A (General <br />Reporting). Such reporting shall continue as long as the property is being used for the originally authorized <br />purpose. Please refer to IB 458a for additional guidance on disposition requirements. <br /> <br />Leasing of Real Property <br />Leasing of real property is permissible if the property is needed to support other allowable annual EMPG <br />Program activities. <br /> <br />Advance Approval Requirement <br />Recipients and subrecipients (through the pass-through entity) must obtain advance written approval from <br />the cognizant FEMA Regional Administrator prior to obligating annual EMPG Program funds for the <br />leasing of real property. <br /> <br />
