<br />Public Hearing:The Planning Commission decision on Conditional Use Permits,
<br />Variances, Tentative Tract and Parcel Maps, Minor Exceptions, Site Plan Review, and
<br />Public Convenience or Necessity Determinations are final unless appealed within 10
<br />days of the decision by any interested party or group (refer to the Basic Meeting
<br />Information page for more information). The Planning Commission recommendation
<br />on Zoning and General Plan amendments, Development Agreements, Specific
<br />Developments, and Specific Plans will be forwarded to the City Council for final
<br />determination. Legal notice was published in the OC Reporter on January 15, 2025

<br />Proposed Project: The applicant is requesting approval of Conditional Use
<br />Permit (CUP) No. 202501 to allow afterhours operation of a new Wendy’s eating
<br />establishment, which is proposed to occupy an existing standalone commercial
<br />pad building with a drivethrough. Pursuant to the Santa Ana Municipal Code,
<br />eating establishments open at any time between the hours of 12:00 a.m. and 5:00
<br />a.m., and located within 150 feet of residentially used or zoned properties, require
<br />approval of a CUP. The Wendy’s afterhours are proposed only for the drive
<br />through operations from Sunday through Thursday 6:00 a.m. to 1:00 a.m. and
<br />Friday and Saturday from 6:00 a.m. to 1:30 a.m. Wendy’s indoor dining area is
<br />only proposed to be open from 6:00 a.m. to 10:00 p.m., sevendays a week.
<br />Environmental Impact: Pursuant to the California Environmental Quality Act
<br />(CEQA) and the CEQA Guidelines, the project is exempt from further review
<br />pursuant to Class 1, Section 15301 (Existing Facilities) of the CEQA Guidelines.
<br />Categorical Exemption ER No. 2024106 will be filed for this project.

<br />Proposed Project: The applicant is seeking approval to modify Conditional
<br />Use Permit No. 201919, allowing an increase in the number of adult day care
<br />participants, from 40 to a maximum of 199 total occupants/individuals, including
<br />participants and staff members, at an existing adult day care center (360 Adult
<br />Day Care). Additionally, the applicant is requesting a modification of Variance No.
<br />201902 to allow a reduction in the required parking spaces, resulting from a
<br />change of use for the secondfloor office space, from professional office to
<br />medical office at the subject property.
<br />Environmental Impact: Pursuant to the California Environmental Quality Act
