RESOLUTION 66-61 AUTHORIZING CONDEMNATION OF <br />AN EASEMENT FOR STREET PURPOSES FOR THE EXTENSION <br />OF FAIRVIEW STREET SOUTHERLY TO WAKEHAM AVENUE <br /> <br /> WHEREAS, Fairview Street is proposed to be a major artery to <br />accommodate the north-south flow of traffic within the City of <br />Santa Aha and a connecting link between the Garden Grove Freeway and <br />the proposed San Diego Freeway; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana hereby finds and declares that the public interest <br />and necessity require that Fairview Street be extended southerly <br />from Talbert Avenue to Wakeham Avenue and the South City Limits to <br />accommodate the north-south flow of traffic within the City, and <br />further require that said City do have, take and acquire, for street <br />purposes, the real property in the City of Santa Aha, County of <br />Orange, State of California, described as: <br /> <br />An easement for street purposes over a strip of land 30.00 feet <br />wide in the land allotted to James McFadden, as described in the <br />Final Decree of Partition of the Rancho Santiago de Santa Ana, <br />which was entered September 12, 1868 in Book "B", page 410 of <br />Judgments of the District Court of the 17th Judicial District in <br />and for the County of Los Angeles, California, the Easterly line <br />thereof being described as follows: <br /> <br />Commencing at the point of intersection of the Southerly prolongation <br />of the Easterly line of the land described in the Deed to Anton <br />H. Segerstrom and Nellie Ruth Segerstrom, et al., recorded <br />September 14, 1960 in Book 5415, page 234 of Official Records, with <br />a line that is parallel with and distant Southerly 59.00 feet, <br />measured at right angles, from the Southerly line of said land <br />of Segerstrom; thence South 88° 47' 15" West along said parallel <br />line 10.50 feet; thence South 0° 52' 19" East to a point in a line <br />that is parallel with and distant Northerly 219.00 feet from the <br />center line of Wakeham Avenue, 60.00 feet wide and the Westerly <br />prolongation thereof; thence South 6° 34' 57" East 220.09 feet to <br />a point in said center line of Wakeham Avenue, said point being <br />distant Easterly 11.41 feet from the point of intersection of <br />said center line with the center line of Fairview Road 60.00 feet <br />wide. <br /> <br />EXCEPTING THEREFROM that portion previously dedicated for street <br />purposes. <br /> <br />ALSO EXCEPTING THEREFROM the Northerly 691.00 feet. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br /> 1. That the City Attorney ks hereby ordered to bring an action <br />in the name of the City of Santa Ana to condemn said property <br />necessary to be taken and to do all things necessary to prosecute <br />said action to final determination; <br /> <br /> 2. That the public interest, necessity and convenience require, <br />and it is hereby ordered, that said City take immediate possession and <br />use of the property herein ordered to be acquired upon compliance with <br />the requirements of law applicable thereto as a right of way for public <br />use; <br /> <br /> 3. That said public improvement is planned and located in a <br />manner which will be most compatible with the greatest public good and <br />the least private injury; <br /> <br />-1- <br /> <br /> <br />
