RESOLUTION 66-74 AUTHORIZING CONDEMNATION OF <br />EASEMENTS FOR STREET PURPOSES FOR THE WIDENING <br />OF WARNER AVENUE FROM ORANGE AVENUE TO THE <br />EAST CITY LIMITS <br /> <br /> WHEREAS, the rapid population growth in the City of Santa Ana <br />and in Orange County makes it necessary that Warner Avenue be widened <br />and improved east from Orange Avenue to accommodate the increasing <br />flow of traffic to the Newport Freeway. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Aha hereby finds and declares that the public interest <br />and necessity require that Warner Avenue be widened and improved from <br />Orange Avenue to the East City Limits to accommodate the east-west <br />flow of traffic and further require that said City do have, take and <br />acquire for street purposes that certain real property in the City of <br />Santa Ana, County of Orange, State of California, described as: <br /> <br />PARCEL 1: <br /> <br />An easement for street purposes over the Northerly 10.00 <br />feet of Lot 37 of Tract 1575, as shown on a map recorded <br />in Book 56, page 36 and 37 of Miscellaneous Maps, records <br />of Orange County, California. <br /> <br />PARCEL 2: <br /> <br />An easement for street purposes over the Northerly 10.00 <br />feet of Lot 38 of Tract 1575, as shown on a map recorded <br />in Book 56, page 36 and 37 of Miscellaneous Maps, records <br />of Orange County, California. <br /> <br />PARCEL 3: <br /> <br />An easement for street purposes over that portion of the <br />land allotted to James McFadden, as described in the <br />Final Decree of Partition of the Rancho Santiago de Santa <br />Ana, which was entered September 12, 1868 in Book "B", <br />page 410 of Judgments of the District Court of the 17th <br />Judicial District in and for Los Angeles County, <br />California, being that portion described in Deeds to <br />H. E. Huntington, Trustee, recorded June 7, 1909 in <br />Book 174, page 258 of Deeds and in Book 174, page 262 of <br />Deeds. lying Northerly of a line parallel with and distant <br />Southerly 40.00 feet from the center line of Delhi Road, <br />now known as Warner Avenue, as shown on a map filed in <br />Book 27, page 30 of Record of Surveys in the office of the <br />County Recorder of Orange County, California. <br /> <br />EXCEPTING that portion previously dedicated for street <br />purposes. <br /> <br />PARCEL 4: <br /> <br />An easement for street purposes over the Northerly 10.00 <br />feet of Lot 12 of Tract 1575, as shown on a map recorded <br />in Book 56, pages 36 and 37 of Miscellaneous Maps, records <br />of Orange County, California. <br /> <br /> BE IT FURTHER RESOLVED: That the City Attorney is hereby <br />ordered to bring an action in the name of the City of Santa Ana to <br />condemn said property necessary to be taken and to do all things <br />necessary to prosecute said action to final determination; <br /> <br /> That the public interest, necessity, and convenience require, <br />and it is hereby ordered, that said City take immediate possession <br />and use of the property herein ordered to be acquired upon compliance <br />with the requirements of law applicable thereto as a right of way for <br />public use; <br /> <br /> That said public improvement is planned and located in a manner <br />which will be most compatible with the greatest public good and the <br />least private injury; <br /> <br /> <br />
