RESOLUTION 66-106 ADDING CONDITIONS TO CONDITIONAL <br />USE PERMIT GRANTED BY THE PLANNING COMMISSION ON <br />APPLICATION FOR CONDITIONAL USE pERMIT NO. 66-7 <br />FILED BY MARTIN ROSTON <br /> <br /> WHEREAS, after public hearing on notice the Planning Commission <br />granted a Conditional Use Permit on Application No. 66-7 filed by <br />MARTIN ROSTON to permit the establishment and operation of a nursery <br />school in an R-1 District at 1143 'Memory Lane, Santa Ana, California, <br />subject to certain conditions; and <br /> <br /> WHEREAS, Appeal Application No. 179 was filed by R. L. SUBRIAR <br />appealing the decision of the Planning Commission to grant said <br />Conditional Use Permit to establish and operate said nursery school <br />with less than the required parking area and requesting the matter <br />be presented ~ the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that said Conditional Use Permit should be granted <br />subject to the conditions hereinbelow set out. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the decision of the <br />Planning Commission to grant a Conditional Use Permit on Application <br />No. 66-7 to permit the establishment of a nursery school in an R-1 <br />District at 1143 Memory Lane, Santa Ana, California, is hereby <br />upheld, but that the following conditions shall apply in the granting <br />of said Conditional Use Permit: <br /> <br />That the applicant submit a revised plot plan showing the building <br /> addition on the easterly side of the lot. Said plan to be <br /> approved by the Planning Department, and development be <br /> according to plan. <br /> <br />That there be not more than 30 children and that one paved and <br /> marked off-street parking space be provided for each <br /> 10 children. (To City standards) <br /> <br />3. That the proposed paving match the existing paving. <br /> <br />That a 6-foot high solid block wall be constructed along the east <br /> property line; said wall shall be reduced to 4 feet within the <br /> required front yard. <br /> <br />5. That garage be widened to minimum of 18 feet or parking spaces <br /> be otherwise provided. <br /> <br />6. That the hours of operation be limited to those hours between <br /> 9 A.M. and 3 P.M. <br /> <br />7. Approval will be made subject to compliance with Title 19. <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE <br />ISSUANCE OF A N3ILDING PERMIT: <br /> <br />That an easement be provided for Memory Lane for a width of <br /> 50 feet, center line to property line, for street purposes <br /> and vehicular access rights, except at approved drives. <br /> NOTE: Access can be determined and approved prior to dedication. <br /> <br />9. That the subdivider submit street improvement plans for Memory <br /> Lane. <br /> <br />10. That all elevations be on 1958 Orange County Survey Datum. <br /> <br />-1- <br /> <br /> <br />
