RESOLUTION 66-118 OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA OPPOSING THE RECOMMENDATIONS <br />MADE BY THE ADVISORY COMMISSION ON INTERGOVERNMENTAL <br />RELATIONS <br /> <br /> WHEREAS, the Advisory C~,,.lssion on Intergovernmental Relations, <br />in its report titled "Building Codes: A Program for Intergovernmental <br />Reform", has recommended a program of federal and state activity <br />including: <br /> <br />1. Development of federal and state model codes, <br />2. Establishment of federal and state research and <br /> testing procedures, <br />3. Establishment of boards of appeal at the state level, <br />4. Requirement of state licensing of inspectors and the <br /> creation of a state agency to establish minimum <br /> staffing and training requirements in local jurisdictions; <br /> <br />and <br /> <br /> WHEREAS, similar proposals have been evaluated and the <br />principals found lacking as evidenced in "Building Codes for Community <br />Development and Construction Progress", published by the United States <br />Chamber of Commerce; and <br /> <br /> WHEREAS, the proposed program would result in the further <br />diminution of the principle of Home Rule in a field where Local <br />Legislators can most effectively solve local problems; and <br /> <br /> WHEREAS, the proposed program would preempt local adoption of <br />model codes and amendments thereto, thereby prohibiting legislative <br />initiative to account for unusual local conditions and to modify <br />such regulations which have proven to be unsafe, unsound, unclear, <br />inappropriate, or in conflict with other regulations; and <br /> <br /> WHEREAS, the present model code organizations' research <br />programs, procedures for acceptance of alternate materials, and methods <br />of construction are now successfully operating and are continuously <br />being improved to the benefit of local goverr~ent, the construction <br />industry, and the public; and <br /> <br /> WHEREAS, all segments of the construction industry actively and <br />progressively support adoption of a model code that is amended <br />annually to keep pace with new develo~nents in the construction <br />industry; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City COuncil of.the <br />City Of Santa Ana hereby reco~nends to the League of California Cities <br />and to its member cities that, in order to preserve local autonomy, <br />this body is opposed to those recommendations made by the Advisory <br />Commission on Intergovernmental Relations in its report titled <br />"Building Code: A Program for Intergovernmental Reform" that would <br />include: <br /> <br />1. Development of federal and state model codes, <br />2. Establishment of federal and state research and <br /> and testing procedures, <br />3. Establishment of boards of appeal at the state level, and <br />4.
