RESOLUTION 66-162 OVERRULING THE DECISION OF <br />THE PLANNING COMMISSION AND GRANTING A VAi%IANCE <br />ON VA 66-40 FILED BY GEORGE L. ARGYROS <br /> <br /> WHEREAS, after hearing on notice, the Planning Commission <br />DENIED a variance on Application VA 66-40, filed by GEORGE L. <br />ARGYROS, and Appeal Application No. 184 was duly filed by the <br />applicant presenting the matter to the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that said Application meets the requirements of <br />Section 9250.8 of the Santa Ana Municipal Code; that the decision <br />of the Planning Commission should be overruled; and that said <br />Variance should be granted subject to the conditions set forth in <br />the Staff Comments of said Variance. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana does hereby overrule the decision of the <br />Planning Commission and does hereby grant a variance on VA 66-40 <br />to permit the construction of a commercial center at the southwest <br />corner of McFadden Avenue and Flower Street in an R-2 District <br />with less than the required parking area. Said Variance is granted <br />subject to the following applicable conditions: <br /> <br />1. That development be according to approved plot plan and eleva- <br /> tions except for minor modifications approved by the <br /> Planning Department; <br /> <br />That a landscaped plan be submitted to and approved by the <br /> Planning Department; said landscaping shall be implemented <br /> and maintained. Planting areas shall be bounded by 6" high <br /> curbs. <br /> <br />That compressors and other equipment be located inside of the <br /> building and insulated so as not to be disturbing to <br /> surrounding residences. <br /> <br />4. That the applicant install a sprinkler system in the landscaped <br /> area. <br /> <br />That all proposed signs be directed away from surrounding <br /> residences and that they be approved by the Planning <br /> Department. <br /> <br />6. That the proposed wall be a decorative solid masonry wall <br /> constructed on the west property lines. <br /> <br />That all signs shall be affixed to the front or street side of <br /> the building and no sign shall contain more than 20 square <br /> feet. In no case shall there be more than three separate <br /> signs. <br /> <br />8. That the proposed building be residentially designed so as to <br /> be compatible with surrounding development. <br /> <br />9. That all off-street parking be paved and marked to City standards. <br /> <br />10. That bumper stops be provided at each parking space. <br /> <br />11. That the driveway on McFadden Avenue be relocated to the westerly <br /> property line. <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE <br />OF A BUILDING PERMIT: <br /> <br />12. That an easement be provided for McFadden Avenue for a width of <br /> 40 feet; and for Flower Street for a width of 40 feet, <br /> <br />-1- <br /> <br /> <br />
