RESOLUTION 67-26 DELINEATING THE POW-ERS <br />AND DUTIES OF THE MUSEUM BOARD <br /> <br /> WHEREAS, members of the Museum Board have inquired of the <br />City Council regarding their responsibilities and powers; and <br /> <br /> W/qEREAS, as set out in the Charter of the City of Santa Aha, <br />the Museum Board is directly responsible to the City Council in its <br />capacity as an advisory agency; while the Museum Director is directly <br />responsible to the City Manager for all Museum administrative matters, <br />including budget preparation, personnel, operation, and maintenance <br />of the Museum; and <br /> <br /> WHEREAS, Sections 900 through 906 of Article IX of the Charter <br />of the City of Santa Ana, Ordinances No. 939 and 1194, Sections <br />2350 through 2353 of the Santa Ana Municipal Code, and Sections 37540 <br />through 37564 of the Government Code all pertain to the Museum and <br />Museum Board, but do not clearly delineate all of the responsibilities <br />and powers of this Board, but rather, in fact, appear to present <br />several conflicts in the respective areas of responsibility of the <br />Museum Board and the Director; and <br /> <br /> WHEREAS, the City Attorney has ruled that the Charter of the <br />City of Santa Ana takes precedence in these areas of conflict; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Aha does hereby adopt the following rules to clarify <br />and delineate the powers and duties of the Museum Board: <br /> <br />The Museum Board shall consider matters that may be referred to <br /> it by the Museum Director, the City Manager, or the City <br /> Council, and render such counsel and advice in regard thereto <br /> as may be requested by the referring authorities. <br /> <br />On <br /> <br />its own motion, the Museum Board may make such studies and <br />investigations as it may deem necessary for the formulation <br />of its policies, plans, and procedures dealing with Museum <br />matters and report i~ findings and recommendations to the <br />Museum Director, the City Manager, or the City Council, or <br />to any or all of the above authorities as it may see fit. <br /> <br />The Museum Board may accept or reject all ~ems (except money) <br /> which have been offered as gifts or loans to the Museum, <br /> but only after they have been recommended for acceptance by <br /> the Museum Director. It shall be part of the Museum <br /> Director's professional responsibility to consider all items <br /> offered to the Museum (except moneh) and to reject those <br /> which he feels are not suitable. Such rejection shall be <br /> final. If the gift or bequest is in the form of money, the <br /> Museum Board and the Director shall recommend to the City <br /> Manager its acceptance or rejection. The City Manager shall <br /> forward these recommendations with his comments, if any, to <br /> the City Council. <br /> <br />The Museum Board shall consider the annual budget during the <br /> process of its preparation by the Museum Director and make <br /> recommendations with respect thereto to the City Manager and <br /> the City Council. <br /> <br />The Museum Board shall solicit to the fullest extent possible <br /> the cooperation of all public and private agencies and <br /> individuals interested in the Museum's programs, including, <br /> but not limited to, the expansion of private financial <br /> support for Museum activities. <br /> <br />-1- <br /> <br /> <br />
