RESOLUTION 67-34 OVERRULING THE DECISION OF THE <br />PLANNING COMMISSION AND GRANTING A VARIANCE ON <br />APPLICATION NO. 66-95 FILED BY JOSAM INVESTMENT <br />COMPANY, SUBJECT TO APPLICABLE CONDITIONS <br /> <br /> WHEREAS, after hearing on notice, the Planning Cormnission <br />DENIED a ~ariance on Variance Application No. 66-95, filed by <br />JOSAM INVESTMENT COMPANY and Appeal Application No. 186 was duly <br />filed by said applicant presenting the matter to the City Council; <br />and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that said Variance Application meets the requirements <br />of Section 9250.8 of the Santa Aha Municipal Code; that the decision <br />of the Planning Commission should be overruled; and that the said <br />Variance should be granted subject to applicable conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana does hereby overrule the decision of the <br />Planning Commission and does hereby grant a variance on Variance <br />Application No. 66-95 to permit the construction of a 140-unit <br />apartment complex that encroaches into required street side yard <br />and rear yard with less than the required parking area at the north- <br />east corner of Harbor Boulevard and Kent Avenue, Santa Ana, Cali- <br />fornia. Said Variance is granted subject to the following applicable <br />conditions: <br /> <br />1. That development be according to the approved plot plan, except <br /> for minor modifications approved by the Planning Department. <br /> <br />That a full landscape plan be submitted to and approved by the <br />Planning Department. All landscaping approved shall be planted <br />and maintained. Planting shall be implemented prior to a <br />utility release. <br /> <br />3. That all requirements of the R 3 District be complied with. <br /> <br />4. That all parking lot lighting be shielded away from residences <br /> to the east. <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE <br />ISSUANCE OF A BUILDING PERMIT: <br /> <br />That an easement be provided for Harbor Boulevard for a width <br />of 60 feet, centerline to property line, for street purposes <br />and vehicular access rights except at street intersections and <br />approved drives. <br /> <br />NOTE: Access can be determined and approved prior to dedication. <br /> <br />NOTE: <br /> <br />Dedication shall be initiated by owner, through the Depart- <br />ment of Public Works, at least two weeks prior to applica- <br />tion for a building permit to avoid delay. <br /> <br />6. That the owner submit street improvement plans for Harbor <br /> Boulevard. <br /> <br />7. That all elevations be on 1958 Orange County Survey Datum. <br /> <br />That all plans and surveys for the required improvements be <br />completed by the owner's engineer and submitted to the Depart- <br />ment of Public Works for approval. <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE <br />ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING <br />SAFETY AND HOUSING: <br /> <br /> <br />
