RESOLUTION NO. 67-45 ORDERING THE STREET <br />SUPERINTENDENT TO ABATE CERTAIN WEEDS <br />HERETOFORE DECLkRED TO BE k PUBLIC NUISA~NCE <br />BY HAVING THE SAME REMOVED <br /> <br />BE IT RESOLVED TPL~T: <br /> <br /> 1. Pursuant to provisions of Chapter 13, Part 2, Division 3, <br />Title 4, of the Government Code of the State of California, the City <br />Council of the City of Santa Ana, having acquired jurisdiction so to <br />do, hereby orders the Street Superintendent of said City to abate the <br />public nuisance heretofore declared to exist in the City of Santa Ana, <br />to wit: weeds which bear seeds of a downy or wingy nature, or dry grass, <br />bursh, or inflammable material which may create a fire hazard, or weeds <br />which are otherwise noxious or dangerous, growing upon certain streets, <br />sidewalks, or private property described in Resolution 67-32 passed and <br />adopted by the City Council of the City of Santa Ana on the 6th day of <br />March, 1967, and reference is hereby made to said Resolution for further <br />and more particular description of said private property. <br /> <br /> 2. Any property owner shall have the right to have any of said <br />weeds removed at his own expense providing the same is done prior to <br />the arrival of the Street Superintendent or his representative to do the <br />same.. <br /> <br /> 3. The Street Superintendent shall keep an account of the cost <br />of abating said nuisance in front of or on each separate lot or parcel <br />of land where the work is done by him or his representatives and shall <br />render an itemized report, in writing, to the City Council of the City <br />of Santa Aha showing the cost of removing such weeds on each separate <br />lot, or in front thereof, or both, providing that a copy of the same, <br />together with a notice showing the time when said report shall be sub- <br />mitted to the Council for confirmation, shall be posted at or near the <br />entrance to the Council Chambers for at least three (3) days prior to <br />the time when said report is to be submitted to the City Council. At <br />the time fixed for receiving and considering said report the City Council <br />shall hear the same, together with any objections which may be raised <br />by any of the property owners liable to be assessed for the work of <br />abating said nuisance, and thereupon make such modifications in the <br />report as they deem necessary, after which said report shall be confirmed. <br />The amounts of the cost for abating such nuisance in front of or upon <br />the various parcels of land mentioned in said report shall constitute <br />special assessments against the respective parcels of land, and, as is <br />made and confirmed, shall constitute a lien on said property for the <br />amount of such assessments, respectively, and thereafter said amounts <br />shall be collected at the same time and in the same manner as ordinary <br />municipal taxes are collected and shall be subject to the same penalties <br />and the same procedure under foreclosure and sale in case of delinquency <br />as provided for ordinary municipal taxes. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa Ana <br />at its regular meeting held on the 3rd day of April, 1967. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br /> <br />
