RESOLUTION 67-79 AUTHORIZING CONDEMNATION OF <br />A FIVE-ACRE PARCEL OF REAL PROPERTY SOUTH OF <br />SANTA CLARA AVENUE, WEST OF PORTOLAPAP~K, <br />FOR THE EXTENSION OF PORTOLA PAR/~ <br /> <br /> W~EREAS, the rapid population growth in the northeasterly <br />portion of the City of Santa Aha makes it necessary that additional <br />space be provided for recreational activities by the extension of <br />Portola Park; and <br /> <br /> WHEREAS, there is land lying without the City Limits that is <br />conveniently adjacent to the existing Portola Park, <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana does hereby find and declare that public interest <br />and necessity require the acquisition of land west of Portola Park <br />as permitted by Sections 5301 and 5302 of the Public Resources Code <br />of the State of California for the extension and enlargement of said <br />Park, and further require that the City do have, take, and acquire, <br />in fee, that certain land in the County of Orange, State of California, <br />described as: <br /> <br />The real property in the Rancho Santiago de Santa Ana, County <br />of Orange, State of California, described as: <br /> <br />Commencing at a point twenty-five (25) rods East of the North- <br />west corner of the "J. W. Davenport Tract" in the "A. B. Chapman <br />Tract", as surveyed by Frank Lecouvrer in December, 1870, and <br />running thence South 32 rods; thence East 25 rods; thence North <br />32 rods and thence West 25 rods to the place of beginning, <br />containing five (5) acres, more or less, RESERVING THEREFROM a <br />strip 25 feet wide along the North line for road purposes. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br /> 1. That the City Attorney is hereby ordered to bring an action <br />in the name of the City of Santa Ana to condemn said property necessary <br />to be taken and to do all things necessary to prosecute said action to <br />final determination; <br /> <br /> 2. That the City of Santa Ana is authorized and empowered to <br />acquire, develop, maintain, and operate public parks within and <br />without the City; <br /> <br /> 3. That the public improvement is planned and located in a <br />manner which will be most compatible with the greatest public good <br />and the least private injury; <br /> <br /> 4. That said action in condemnation shall be taken in accord- <br />ance with the provisions of the Code of Civil Procedure, the Public <br />Resources Code, and the Constitution of the State of California <br />relating to eminent domain. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 5th day of June, 1967. <br /> <br />CLERK OF THE COUNCIL <br /> <br />-1- <br /> <br /> <br />
