RESOLUTION 67-23 ACCEPTING A DEED FROM ALLSTATE <br />INSURANCE COMPANY WITH NO CASH CONSIDERATION <br />BUT SUBJECT TO CERTAIN CONDITIONS <br /> <br /> WHEREAS, ALLSTATE INSURANCE COMPANY, an Illinois corporation, <br />has executed a deed dated January 12, 1967, conveying to the City <br />of Santa Aha easements for street purposes on the south side of <br />Fourth Street and the east side of the Santa Ana Freeway; and <br /> <br /> WHEREAS, said deed is granted with no cash consideration, but <br />subject to certain conditions to be c~plied with prior to the <br />recording of said deed; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana <br />accepts said deed from ALLSTATE INSURANCE COMPANY and approves the <br />following conditions as consideration for said conveyance: <br /> <br />The City will at its sole expense do all work necessary to <br />repair and/or replace any damaged Allstate property as re- <br />quired to return it to its original condition which shall <br />include, but not necessarily be limited to the following <br />specific items: <br /> <br />Reconstruct the four driveway entrances to Allstate <br />Insurance Company's ("Allstate") property and repair <br />or replace any curbs, lawns, shrubbery, trees or <br />other improvements damaged or destroyed by the pro- <br />posed widening of Fourth Street. Included will be <br />the complete construction of new entrance at east <br />side of property with all associated curb, fence, <br />paving, tree and planting removal. The new drive- <br />way shall be essentially as shown on sketch received <br />with your letter of December 27, 1966 complete with <br />necessary painting of pavement arrows and lines. <br />Area of removal of existing driveway shall be left <br />in suitable condition for planting ivy by owner. <br /> <br />Install a new full width concrete sidewalk along <br />entire frontage of Allstate's property. Sidewalk <br />to be full width from curb to property lines. Trees <br />will be planted at approximately 50 foot spacings in <br />sidewalk area. <br /> <br />Relocate light fixtures adjacent to Allstate's front <br />entrances to a place satisfactory to Allstate to <br />clear new street construction. <br /> <br />Allstate will endeavor as far as possible to clear <br />all new street construction with their new irriga- <br />tion system and landscaping. The City will repair <br />and replace all lawn, shrubbery, sprinkler heads or <br />any other improvements damaged by the construction. <br /> <br />5. Provide left turn lane for west bound traffic into <br /> Atlstate's westerly most entrance to their property. <br /> <br />which conditions must be complied with prior to the recording of <br />this deed. <br /> <br /> BE IT FURTHER RESOLVED: That Carl J. Thornton, the City's <br />designated agent, is directed to place his certificate of Acceptance <br />on said deed. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 20th day of February, 1967. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br /> <br />
