RESOLUTION 67-112 RECOMMENDING THE RESCISSION <br />OR REPEAL OF MANDATORY REQUIREMENTS OF SECTIONS <br />204, 205, and 206 OF TITLE II OF THE DEMON- <br />STRATION CITIES AND METROPOLITAN DEVELOPMENT <br />ACT OF 1965 <br /> <br /> WHEREkS, the 89th Congress enacted Public Law 89-754 entitled <br />"Demonstration Cities and Metropolitan Development Act of 1966"; and <br /> <br /> WHEREAS, Title II of said Act, "Planned Metropolitan Development" <br />provides that after June 30, 1967, all applications for Federal loans <br />or grants-in-aid not only for open space land projects but also for <br />hospitals, airports, libraries, water supply and distribution facilities, <br />sewerage facilities and waste treatment works, highways, transportation <br />facilities, and water development and land conservation within any <br />Metropolitan Area shall be submitted and reviewed by an areawide agency <br />designated to perform Metropolitan and Regional Planning; and <br /> <br /> WHEREAS, other Federal Acts, including but not limited to the <br />Housing and Urban Development Act of 1965, Federal Water Pollution <br />Control Act, the Urban Mass Transportation Act of 1964, and the Housing <br />Act of 1961 are subject to the same or similar requirements; and <br /> <br /> WHEREAS, these mandatory requirements force Federal dictation and <br />control in strictly local affiars in violation of the principles and <br />concepts of home rule and in matters best left to the determination of <br />local elected officials who are more acquainted with and cognizant of <br />the needs and desires of their constituents; and <br /> <br /> WHEREAS, it is believed that the advice and consent of officials <br />and persons in neighboring Cities and the County of Orange may not be <br />in the best interest nor necessary or advisable in determining the <br />best methods of procedures in fulfilling the needs of the City of Santa <br />Ana and its residents as required in said Federal Legislation; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana respectfully requests Congressmen Richard T. Hanna and <br />James B. Utt to prepare or cause to be prepared and support legislation <br />in the Congress of the United States, rescinding or repealing the <br />mandatory requirements in Sections 204, 205, and 206 of Title II of the <br />Demonstration Cities and Metropolitan Development Act of 1966, and <br />similar requirements in all other Federal Acts which make mandatory a <br />review by an Agency which is designated to perform metropolitan or <br />regional planning for an area as a prerequisite for Federal loans and <br />grants-in-aid to local agencies in constructing or providing vitally <br />needed public works projects and local facilities. <br /> <br /> BE IT FURTHER RESOLVED: That the Clerk of the Council is hereby <br />directed and authorized to forward copies of this Resolution to the <br />Honorable Senator Thomas Kuchel; the Honorable George Murphy and <br />Congressmen Richard T. Hanna and James B. Utt, and to such other public <br />officials or agencies who believe in the concept and principle of home <br />rule and wish to join with the City of Santa Ana in its fight to retain <br />management and control of its own local affairs. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa Aha <br />at its regular meeting held on the 3rd day of July, 1967. <br /> <br />ATTEST: <br /> <br /> <br />
