RESOLUTION 67-171 AUTHORIZING EXECUTION OF A <br />DEED TO GILBERT K. RANNEY ET AL WITH NO CASH <br />CONSIDERATION <br /> <br /> WHEREAS, by Judgment in Condemnation the City of Santa Aha <br />has acquired fee title in and to certain land on the west side of <br />Harbor Boulevard, south of First Street, for drainage purposes, <br />and in said Judgment in Condemnation GILBERT Ko RANNEY, as Executor <br />of the Estate of KENNETH W. RANNEY, deceased, and HUMPHRIES INVEST- <br />MENTS, INCORPORATED, were granted an easement over and across said <br />property; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the Mayor and the Clerk <br />of the Council are hereby authorized and directed to execute a deed <br />granting to GILBERT K. RANNEY, as Executor of the Estate of KENNETH <br />W. RANNEY, deceased, and HUMPHRIES INVESTMENTS, INCORPORATED, the <br />following described easement: <br /> <br />An easement over, across, and above the following described property <br />in the City of Santa Ana, County of Orange, State of California: <br /> <br />The southerly 35.00 feet of the east half of the northeast quarter <br />of the northeast quarter of Section 16, Township 5 South, Range <br />10 West, in the Rancho Las Bolsas, as shown on a map recorded in <br />Book 51, Page 12, of Miscellaneous Maps, Records of Orange County, <br />California. <br /> <br />EXCEPTING THEREFROM the easterly 50.00 feet; <br /> <br />together with the right to cover said channel at their own expense, <br />provided said covering be accomplished upon a permit duly issued <br />by the City of Santa Aha, and provided further that said covering <br />be accomplished to the specifications of the City of Santa Ana. <br />This easement and the rights attached thereto as described herein <br />may be leased, subleased, assigned or conveyed without restriction <br />by the grantees therein, provided, however, that said easement <br />shall remain and said covering may be maintained so long as a <br />possessory interest in and to the land immediately adjacent thereto <br />and presently leased to GILBERT K. RANNEY, as Executor of the Estate <br />of KEA/NETH W. RANNEY, deceased, and HUMPHRIES INVESTMENTS, INCOR- <br />PORATED, are held by the same person(s) or entity. <br /> <br />No structure of any kind may be erected upon said easement. Its <br />use shall be restricted to provide parking space or access roads <br />or driveways along or across said easement, <br /> <br />and deliver the same to said grantee. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 18th day of September, 1967. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />-1- <br /> <br /> <br />
