RESOLUTION 67-196 MODIFYING SIDEWALK REQUIREMENTS <br />IMPOSED BY THE ZONING ADMINISTRATOR IN GRANTING A <br />VARIANCE ON APPLICATION NO. 67-81 FILED BY VOIT <br />RUBBER CORPORATION <br /> <br /> WHEREAS, after public hearing on notice the Zoning Adminis- <br />trator granted a Variance on Application No. 67-81, filed by VOIT <br />RUBBER CORPORATION, to permit off street parking with less than the <br />required number of spaces in an M-1 District at 3801 South Harbor <br />Boulevard, Santa Ana, California; said Variance was granted subject <br />to certain applicable conditions; and <br /> <br /> WHEREAS, Appeal Application No. 197 was duly filed by the <br />applicant appealing the requirement that a full width sidewalk be <br />placed on Harbor Boulevard and Sunflower Avenue which was imposed <br />by the Zoning Administrator in his approval of said Variance 67-81; <br />and <br /> <br /> Wq~EREAS, after public hearing on notice, the City Council has <br />determined that Condition No. 7 of the Findings of Fact of the Zoning <br />Administrator should be modified to read as hereinbelow set out. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the finds made and the <br />conditions imposed by the Zoning Administrator are approved except <br />that Condition No. 7 of the Findings of Fact on said Variance shall <br />read as hereinbelow set out; said Variance is granted subject to the <br />following conditions: <br /> <br />That the development otherwise be according to the approved plot <br /> plan except for minor modifications approved by the Planning <br /> Department; <br /> <br />2. That a detailed landscape plan for the area around the proposed <br /> building be submitted to and approved by the Planning Department; <br /> <br />That in the event the total number of employees using the off- <br /> street parking facilities is greater than the number of available <br /> parking spaces, then the applicant shall provide additional <br /> off-street parking facilities in direct proportion to the <br /> demand. <br /> <br />4. That the use of the premises be limited to W. J. Voit Rubber <br /> Corporation. <br /> <br />THE FOLLOWING CONDITION IS TO BE COMPLIES WITH PRIOR TO THE ISSUANCE <br />OF A BUILDING PERMIT: <br /> <br />o <br /> <br />That a deed be provided for access rights to Sunflower Avenue at <br /> the location where the existing drive is closed. The City will <br /> quitclaim access rights on Sunflower Avenue at the location of <br /> the proposed new drive. <br /> <br />NOTE: <br /> <br />Dedication shall be initiated by owner, through the <br />Department of Public Works, at least two weeks prior to <br />application for a building permit to avoid delay. <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO ISSUANCE OF <br />UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: <br /> <br />That the owner provide sanitary sewer facilities and pay the <br /> remaining District 7 sewer charges ($1,120.80 to be paid). <br /> <br />That the owner construct full width sidewalks for the entire <br /> length of their property along Harbor Boulevard and Sunflower <br /> Avenue at such time as adjacent property is developed or at <br /> the end of five years, whichever is sooner. <br /> <br />-1- <br /> <br /> <br />
