RESOLUTION 67-198 OVERRULING THE DECISION OF <br />THE ZONING ADMINISTRATORAND GRANTING A VARIANCE <br />ON APPLICATION NO. 67-95 FILED BY GEORGE L. TANEY <br />SUBJECT TO APPLICABLE COATDITIONS <br /> <br /> WHEREAS, after hearing on notice, the Zoning Administrator <br />denied a variance on Variance Application No. 67-95 filed by <br />GEORGE L. TANEY, and Appeal Application No. 199 was duly filed by <br />the applicant presenting the matter to the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that said Variance Application meets the requirements <br />of Section 9250.8 of the Santa Ana Municipal Code; that the decision <br />of the Zoning Administrator should be overruled; and that said <br />Variance should be granted subject to applicable conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana does hereby overrule the decision of the Zoning <br />Administrator and does hereby grant a variance on Application No. 67-95 <br />to permit the construction of a building at 410 West First Street in <br />the City of Santa Ana for automobile repair use on property zoned <br />c-1. Said Variance is granted subject to the following applicable <br />conditions: <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE <br />OF A BUILDING PERMIT: <br /> <br />That easements be provided for north-south alley and for east-west <br /> alley for a width of 10 feet, center line to property line, for <br /> street purposes and for vehicular access rights to First Street, <br /> except at alley. The above easements to include alley corner <br /> cut-offs. (No access allowed from First Street.) <br /> <br />NOTE: <br /> <br />Dedication shall be initiated by owner, through the <br />Department of Public Works, at least two weeks prior <br />to application for a Building Permit to avoid delay. <br /> <br />2. That the subdivider submit street improvement plans for north- <br /> south alley and east-west alley. <br />3. That all elevations be on 1958 Orange County Survey Datum. <br />4. That all plans and surveys for the required improvements be <br /> completed by the owner's engineer and submitted to the Depart- <br /> ment of Public Works for approval. <br /> <br />THE FOLLOWING CONDITIONS A~E TO BE COMPLIED WITH PRIOR TO ISSUANCE <br />OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: <br /> <br />1. That the owner provide sanitary sewer facilities to meet with the <br /> approval of the Department of Public Works. <br />2. That the owner place alley improvements for full width of existing <br /> right of way with gutter on future center line of alley. <br />3. That the owner pay a sewer assessment reimbursement of $3.00 per <br /> front foot for First Street. <br />4. That the owner construct a block or solid masonry wall not less <br /> than 6 feet high on the west property line between the alley <br /> and the building. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 20th day of November, 1967. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />-1- <br /> <br /> <br />
