RESOLUTION 67-212 AUTHORIZING THE EXCHAiqGE OF
<br />PROPERTIES BETWEEN THE CITY AND kLFRED J.
<br />GUTIERREZ AND FRIEDA GUTIERREZ ON THE NORTH
<br />SIDE OF FIRST STREET, EAST SIDE OF HESPERIAN,
<br />WITH CASH CONSIDERkTION DUE TO THE GRANTEE
<br />
<br /> WHEREAS, ALFRED J. GUTIERREZ and FRIEDA GUTIERREZ, also known
<br />as Edpidia F. Gutierrez, have executed a deed dated November 1, 1967,
<br />conveying to the City of Santa Ana an easement for street purposes
<br />on the north side of First Street, and the east side of Hesperian,
<br />with a cash consideration of $17,347.00 in exchange for which ~e City
<br />will convey to said ALFRED J. GUTIERREZ and FRIEDA GUTIERREZ other real
<br />property which has been declared surplus on the north side of First
<br />Street, east of Hesperian, which property has a cash value of
<br />$8,815.00, the sale of which was authorized by the City Council of
<br />the City of Santa Ana on October 19, 1967; and
<br />
<br /> WHEREAS, the CITY OF SANTA kNA, has agreed to pay to
<br />Alfred J. Gutierrez and Frieda Gutierrez the difference in equity of
<br />the interest in real property being exchanged hereby in the amount
<br />of $8,532.00; and
<br />
<br /> WHEREAS, said transaction is to be handled through Escrow
<br />Number 55318-C with Security Title Insurance Company, Santa Ana,
<br />California.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana
<br />accepts said deed from Alfred J. Gutierrez and Frieda Gutierrez
<br />granting to the City the following described property:
<br />
<br /> Ail that certain land situated in the State of California, County
<br />of Orange, City of Santa Ana, described as follows:
<br />
<br />PARCEL 1: Thel South 40.00 feet of Lots 10 and 11 and the
<br />South 40.00 feet of the West 27 feet of Lot 12 in Block D
<br />of Goldsmith's Addition to Santa Ana, in the City of Santa
<br />Ana, as shown on a map recorded in Book 31, page 23 of
<br />Miscellaneous Records of Los Angeles County, California.
<br />
<br />PARCEL 2: A spandrel shaped parcel of land in Lot 10,
<br />Block D of Goldsmith's Addition to Santa Ana, in the City of
<br />Santa Ana, as shown on a map recorded in Book 31, page 23,
<br />of Miscellaneous Records of Los Angeles County, California
<br />bounded Southerly by the North line of Parcel 1; bounded
<br />Westerly by the West line of said Lot 10; bounded Northeasterly
<br />by the arc of a curve concave Northeasterly, having a radius
<br />of 25 feet, and tangent to the West line of Lot 10 and the
<br />North line of Parcel 1 above described.

<br />Grantors also grant to the City of Santa Ana, a temporary
<br />easement over the East 16 feet of Lot 11 and the West 27
<br />feet of Lot 12, Block D of said Goldsmith's Addition to
<br />Santa Ana, for the purpose of demolishing the building
<br />situated thereon. Said easement to terminate February 1,
<br />1968 or upon demolition of the building as disclosed by the
<br />recordation of a notice of completion, whichever first occurs.

<br />and Carl J. Thornton, the City's designated agent, is directed to
<br />place his Certificate of Acceptance on said deed:

<br /> BE IT FURTHER RESOLVED: That the Mayor and the Clerk of the
<br />Council are hereby authorized and directed to execute a deed for and
<br />on behalf of the City of Santa Ana granting to Alfred J. Gutierrez
<br />and Frieda Gutierrez that certain real property in the City of Santa
<br />Ana, County of Orange, State of California, described as:
<br />
<br />Lot 12 and the West 18 feet of Lot 13 in Block D of Goldsmith's
<br />Addition to the Town of Santa Ana, in the City of Santa Ana,
<br />
