RESOLUTION 68-1 OVERRULING THE DECISION OF THE <br />PLANNING COMMISSION AND GRANTING A VARIANCE ON <br />APPLICATION 67-102 FILED BY WESTMARK DEVELOPMENT CO., <br />SUBJECT TO APPLICABLE CONDITIONS <br /> <br /> W~EREAS, after hearing on notice, the Planning Commission <br />DENIED a variance on Variance Application 67-102 filed by WESTMARK <br />DEVELOPMENT COMPANY, and Appeal Application No. 202 was duly filed <br />by the applicant presenting the matter to the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />and on the basis of the revised plan submitted by the applicant, has <br />determined that said variance meets the requirements of Section 9250.8 <br />of the Santa Ana Municipal Code; that the decision of the Planning <br />Commission should be overruled; and that said variance should be <br />granted subject to applicable conditions; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana does hereby overrule the decision of the Planning <br />Cor~mission and does hereby grant a variance on Variance Application <br />67-102 to permit the construction of a 48-unit apartment complex <br />in a C-1 Dis trict located at 1313 West Memory Lane, Santa Ana, <br />California. said Variance is granted subject to the following <br />applicable conditions: <br /> <br />That a detailed landscaped plan be submitted to and approved by <br /> the Planning Department, said plan to be implemented and <br /> continuously maintained. <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE <br />OF A BUILDING PERMIT: <br /> <br />2e <br /> <br />That the subdivider's engineer furnish the Department of Public <br /> Works a runoff study based on a storm of a ten-year frequency. <br /> This study to show existing and proposed facilities and method <br /> of draining this area and tributary areas without exceeding <br /> the capacity of any street on-site or off-site. <br /> <br />e <br /> <br />That an easement be provided for Memory Lane for a width of <br /> 50 feet, center line to property line, for street purposes <br /> and vehicular access rights to Memory Lane except at approved <br /> drives. <br /> NOTE: Access can be determined and approved prior to dedication. <br /> NOTE: Dedication shall be initiated by owner, through the <br /> Department of Public Works, at least two weeks prior to <br /> application for a building permit to avoid delay. <br /> <br />4. That all elevations be on 1958 Orange County Survey Datum. <br /> <br />5. That the subdivider submit street improvement plans for Memory <br /> Lane. <br /> <br />6e <br /> <br />That all plans and surveys for the required improvements be <br /> completed by the owner's engineer and submitted to the <br /> Department of Public Works for approval. <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE <br />OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: <br /> <br />7. That the owner provide sanitary sewer and storm drain facilities <br /> to meet with the approval of the Department of Public Works. <br /> <br />Be <br /> <br />That the owner place curb, gutter, and sidewalk and pave up to <br /> the edge of existing pavement on Memory Lane.
