RESOLUTION 68-4 DELETING DEDICATION REQUIREMENTS <br />FROM CONDITIONS IMPOSED BY THE PLANNING COMMISSION <br />IN GR3~NTING CONDITIONAL USE PERMIT ON APPLICATION <br />NO. 67-12 FILED BY DAVID AND PATRICK PRIZIO <br /> <br /> WHEP~EAS, after public hearing on notice, the Planning <br />Commission has granted Conditional Use Permit No. 67-12 on appli- <br />cation filed by DAVID and PATRICK PRIZIO to permit the use of an <br />industrial building at 1521-1535 South Grand Avenue, Santa Aha, <br />in an M-1 District, for office purposes; said Conditional Use <br />Permit was granted subject to certain conditions; and <br /> <br /> WHEREAS, Appeal Application No. 203 was duly filed by the <br />applicants, appealing the condition imposed by the Planning <br />Commission requiring the dedication of a 5-foot easement for Grand <br />Avenue, and presenting the matter to the City Council; and <br /> <br /> WHEREAS, after public hearing on notice, the City Council <br />found Condition No. 4 to be unreasonable under existing circumstances <br />and that it should be deleted from the conditions imposed by the <br />Planning Commission in granting said Conditional Use Permit; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana does hereby overrule the decision of the Planning <br />Commission and deletes Condition No. 4 imposed by the Planning <br />Commission in granting said Conditional Use Permit. Said Conditional <br />Use Permit is granted subject to the following conditions: <br /> <br />That a revised plot plan of the off-street parking spaces on <br /> the west side of the building be submitted to the Planning <br /> Department for approval and that the development be according <br /> to the revised plot plan, except for minor modifications <br /> approved by the Planning Department; <br /> <br />That this approval does not permit any commercial retail sales <br /> or activities on the subject property unless clearly secondary <br /> to a permitted use; and <br /> <br />That the recorded easement be provided for ingress and egress <br /> over that portion of the westerly 20 feet of Lot 12, Tract <br /> 4471, for use by the subject property for a period equal to <br /> the life of the office use. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 15th day of Ja~, I~3<68. <br /> <br />~LERK OF THE COUNCIL <br /> <br />STATE OF CALIFORNIA) <br />COUNTY OF ORANGE ) <br />CITY OF SANTA ANA ) <br /> <br />SS <br /> <br /> I, DORIS M.
