RESOLUTION 68-12 OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA MAKING APPLICkTION TO THE <br />ORANGE COUNTY LOCAL AGENCY FORMATION COMMISSION <br />RELkTIVE TO A PROPOSAL TO DETACH CERTAIN TERRITORY <br />NOW A PART OF EAST ORANGE COUNTY WATER DISTRICT <br />AND TO ATTACH THE DETACHED PORTION TO THE WATER <br />SUPPLY SYSTEM OF THE CITY OF SANTA ANA <br /> <br /> WHEREAS, the City of Santa Ana, acting through its city <br />Council, purchased a portion of the Tustin Water Works; and <br /> <br /> WI~EREAS, this purchase transaction was formalized through <br />the execution of a number of documents and a written application <br />made to the Public Utilities Commission of the State of california <br />seeking approval of the aforementioned sale and purchase agreement; <br />all of the documents above referred to are now combined in a single <br />exhibit, marked "EXHIBIT 1" for identification, which is attached <br />hereto and made a part hereof by this reference. The written <br />decision of the Public utilities Commission approving the purchase <br />agreement is marked "EXHIBIT 2", attached hereto and made a part <br />hereof by this reference; and <br /> <br /> WHEREAS, a small portion of the East Orange County Water <br />District lying within the territory of the Tustin Water Works <br />purchased by the City of Santa Ana as aforesaid, and the exact <br />description of said territory is contained in E)fHIBIT 3, attached <br />hereto and made a part hereof by this reference; and <br /> <br /> WHEREAS, the best interests of the East Orange County Water <br />District, the City of Santa Ana, and the residents and present and <br />future users of water within the area before described require that <br />this area be detached from the East Orange County Water Distrist. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Aha does hereby request the Orange County Local Agency <br />Formation Commission to approve the detachment of the before described <br />territory as shown in EXHIBIT 3, hereinabove referred to, from the <br />East Orange County Water District. <br /> <br />BE IT FURTHER RESOLVED: That this City Council declares: <br /> <br />1. This proposal is made under the authority of and pursuant to <br /> the District Reorganization Act of 1965; <br /> <br />2. The territory proposed to be detached is inhabited; <br /> <br />3. The reasons for this proposal are: <br /> <br />a) <br /> <br />Formerly the territory of the Tustin Water Company <br />purchased by the City of Santa Ana obtained its water <br />from the East Orange County Water District. The City <br />of Santa Ana does not need the service of the East <br />Orange County Water District as it is permitted to <br />and does in fact deal directly with Metropolitan Water <br />District which supplies it with water; <br /> <br />b) <br /> <br />If the territory in question is not detached the <br />residents and users, both present and prospective, <br />will continue to be taxed by the East Orange County <br />Water District for a service no longer provided by <br />the Water District but now provided by the City of <br />Santa Ana which in turn will be compelled to charge <br />the users for the water supplied to them, which will <br />result in double charges to the users and residents; <br /> <br /> <br />
