RESOLUTION 68-75 AUTHORIZING CONDEMNATION OF AN <br />EASEMENT FOR WATER MAIN PURPOSES ADJACENT TO THE <br />CITY OF SANTA ANA'S WATER CONTROL STATION AT <br />MAYWOOD AVENUE AND RITCHEY STREET <br /> <br /> W~EREAS, because of the rapid development of that area lying <br />southeasterly of the City of Santa Ana and the increasing demands <br />for potable water in said area, it is necessary that a new water main <br />be constructed to meet these demands; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Aha <br />hereby finds and declares that public interest and necessity require <br />the construction of a 12-inch water main across the MPG Ranch property <br />adjacent to the City of Santa Ana's Water Control Station at Maywood <br />Avenue and Ritchey Street in the County of Orange to provide for an <br />underground potable water supply and further require that said City <br />do have, take, and acquire for water main purposes that certain real <br />property in the County of Orange, State of California, described as: <br /> <br />An easement for an underground potable water line over that <br />portion of the Southeast quarter of the Southwest quarter of <br />Section 20, Township 5 South, Range 9 West, San Bernardino Base <br />and Meridian, in the County of Orange, State of California, <br />described as follows: <br /> <br />Commencing at the center line intersection of Newport Avenue and <br />Warner Avenue; said center line of Warner Avenue being also the <br />South line of said Section 20; thence North 40° 39' 12" East, <br />71.79 feet, along said center line of Newport Avenue; thence <br />North 49° 20' 48" West, 136.00 feet; thence North 40° 39' 12" East, <br />88.03 feet, to the True Point of Beginning; thence continuing <br />North 40° 39' 12" East, 11.97 feet, to the most Southerly corner <br />of the land described in the deed to the City of Santa Ana, <br />recorded on April 8, 1964 in Book 6995, Page 445, Official Records, <br />in the office of the County Recorder of said County; thence along <br />the Southwesterly line of said land of the City of Santa Aha, <br />North 49° 20' 48" West, 15.29 feet; thence Southerly, in a direct <br />line, to the True Point of Beginning. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br /> 1. That the City Attorney is hereby ordered to bring an <br />action in the name of the City of Santa Ana to condemn said property <br />necessary to be taken and to do all things necessary to prosecute <br />said action to final determination; <br /> <br /> 2. That public interest, necessity, and convenience require, <br />and it is hereby ordered, that said City take immediate possession <br />and use of the property herein ordered to be acquired upon compliance <br />with the requirements of law applicable thereto as a right of way for <br />public use; <br /> <br /> 3. That said public improvement is planned and located in a <br />manner which will be most compatible with the greatest public good <br />and the least private injury; <br /> <br /> 4. That the City of Santa Aha is authorized and empowered to <br />provide for the supplying of water to the citizens and businesses <br />within and without the City and all mains, lines, valves, vaults, <br />reservoirs, and works appurtenant thereto to carry out said purpose, <br />and to extend, improve, construct, and maintain said water works system. <br /> <br /> 5. That said action in condemnation shall be taken in accord- <br />ance with the provisions of the Code of Civil Procedure and the <br />Constitution of the State of california relating to eminent domain. <br /> <br />-1- <br /> <br /> <br />
