RESOLUTION 68-87 AUTHORIZING EXECUTION OF A <br />DEED TO WETZEL & ASSOCIATES TO RECONVEY FEE <br />ERRONEOUSLY coNVEYED TO THE CITY AND RETAINING <br />AN EASEMENT FOR STREET PURPOSES <br /> <br /> WHEREAS, by deed dated February 22, 1968, Wetzel & Associates, <br />a partnership, conveyed to the City of Santa Ana a fee interest in <br />and to certain real property; and <br /> <br /> WHEREAS, the intent of Wetzel & Associates, as well as the <br />City of Santa Ana was that Wetzel & Associates would convey to the <br />City of Santa Ana only an easement for street purposes in and to <br />said real property; and <br /> <br /> WHEREAS, it is the desire of the City Council that the effect <br />of said erroneous deed be corrected; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED= That the City of Santa Ana <br />reconvey to Wetzel & Associates the fee title which it heretofore <br />erroneously conveyed to the City, but reserving unto the City of <br />Santa Ana the easement for street purposes which all parties <br />originally intended the City to possess; <br /> <br /> BE IT FURTHER RESOLVED: That the Mayor and the Clerk of the <br />Council are hereby authorized and directed to execute deed recon- <br />veying to Wetzel & Associates the following described real property <br />in the City of Santa Ana, County of Orange, State of California: <br /> <br />Ail that certain land situated in the State of California, <br />County of Orange, City of Santa Ana, described as follows: <br /> <br />That portion of the land allotted to Frederick W. Koll as <br />described in the Final Decree of Partition of the Rancho <br />Santiago de Santa Ana, a certified copy of which was recorded <br />September 12, 1868 in Book "B", page 410 of Judgments of the <br />District Court of the 17th Judicial District in and for Los <br />Angeles County, California, described as follows: <br /> <br />Beginning at the Northwest corner of Parcel 2 as shown on Map <br />filed in Book 7, page 46 of Parcel Maps, records of said County; <br />thence along the Westerly line of said Parcel 2, South 1° 20' 57" <br />West 210.00 feet to the true point of beginning, said point being <br />the beginning of a tangent curve concave Northeasterly, having <br />a radius of 15.00 feet; thence Southerly, Southeasterly and <br />Easterly along said curve through a central angle 90° 00' 00" <br />an arc distance of 23.56 feet; thence South 88° 39' 03" East <br />534.60 feet to the beginning of a tangent curve concave South- <br />westerly having a radius of 85.40 feet; thence Easterly, South- <br />easterly, and Southerly along said curve through a central angle <br />of 90° 00' 00" an arc distance of 134.15 feet to the beginning <br />of a compound curve concave Northwesterly having a radius of <br />255.00 feet; thence Southerly, Southwesterly and Westerly along <br />said curve through a central angle of 90° 00' 00" an arc distance <br />of 400.55 feet; thence North 88° 39' 03" West 365.00 feet to the <br />beginning of a tangent curve concave Southeasterly having a <br />radius of 15.00 feet; thence Westerly, Southwesterly and Southerly <br />along said curve through a central angle of 90° 00' 00" an arc <br />distance of 23.56 feet to a point in the Westerly line of Parcel 2 <br />of said Parcel Map, said point being South 1Q 20' 57" West along <br />said Westerly line 580.51 feet from the Northwest corner of said <br />Parcel 2; thence along said Westerly line North 1° 20' 57" East <br />90.00 feet to the beginning of a tangent curve concave North- <br />easterly having a radius of 15.00 feet; thence Southerly, South- <br />easterly and Easterly along said curve through a central angle <br />of 90° 00' 00" an arc distance of 23.56 feet; thence South <br />88° 39' 03" East 365.00 feet to the beginning of a tangent curve <br /> <br /> <br />
