RESOLUTION 68-104 AFFIRMING THE DECISION OF THE <br />PLANNING COMMISSION AND GRANTING A VARIANCE ON <br />VARIANCE APPLICATION 68-53, FILED BY HIRSCO <br />CORPORATION, SUBJECT TO CERTAIN CONDITIONS <br /> <br /> WHEREAS, after public hearing on notice, the Planning <br />Commission granted a variance on VA 68-53, filed by HIRSCO <br />CORPORATION, to permit the construction of a 282-unit apartment <br />complex at 2901 North Bristol Street, Santa Ana, California, in <br />an A-1 District; and <br /> <br /> WHEREAS, Appeal Application No. 208 was filed by VILLA DE <br />FLORES HOMEOWNERS' ASSOCIATION appealing the decision of the Planning <br />Commission and presenting the matter to the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that said Variance Application meets the requirements <br />of Section 9250.8 of the Santa Ana Municipal Code and that said <br />Variance should be granted subject to conditions imposed by the <br />Planning Commission and the City Council; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana does hereby affirm the decision of the Planning <br />Commission and does hereby grant a variance on VA 68-53, filed by <br />HIRSC0 CORPORATION, to permit the construction of a 282-unit apartment <br />complex at 2901 North Bristol Street, Santa Ana, California; said <br />Variance is granted subject to the following conditions: <br /> <br />That a revised plot plan be submitted to and approved by the <br /> Planning Commission which indicates a minimum of 8,000 square <br /> foot lots on the north side of West Orange Road, and that <br /> final subdivision maps for R-1 development be filed and <br /> approved; that there be no residential units within 88 feet <br /> of the east property line; and further, that the applicant <br /> execute an agreement with the City to provide that in each <br /> deed for the sale of all lots there shall be a limitation of <br /> the use of the same to single family home construction, which <br /> limitation shall be irrevocable for a period of 10 years, said <br /> agreement to be executed before a building permit is issued. <br /> <br />That no access be permitted from the apartment Complex onto West <br /> Orange Road except for an opening for a crash gate for <br /> emergency access if required by the Fire Department. <br /> <br />3. That the revised plot plan indicate a minimum of approximately <br /> 50% open space on the apartment complex site. <br /> <br />That all second floor apartments (including the bachelor apart- <br /> ments over garages) have minimum 5' x 8' private balconies, <br /> and that all first floor apartments have private patios with <br /> minimum dimensions of 10' x 22'. Said patios shall be enclosed <br /> by a solid 6' fence or wall. <br /> <br />5. That the revised plot plan indicate the minimum number of off- <br /> street parking spaces required by ordinance. <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE <br />OF A BUILDING PERMIT: <br /> <br />That the subdivider's engineer furnish the Department of Public <br /> Works a runoff study based on a storm of a ten-year frequency. <br /> This study to show existing and proposed facilities and <br /> method of draining this area and tributary areas without <br /> exceeding the capacity of any street on-site or off-site. <br /> <br />-1- <br /> <br /> <br />
