RESOLUTION 68-144 OVERRULING THE DECISION OF THE <br />ZONING ADMINISTRATORAND GRANTING A VARIANCE ON <br />APPLICATION 68-82 FILED BY GLEN C. J. FREESE <br />SUBJECT TO APPLICABLE CONDITIONS <br /> <br /> WHEREAS, after public hearing on notice, the Zoning Adminis- <br />trator DENIED a variance on Variance Application 68-82 filed by <br />GLEN C. J. FREESE proposing to use the recently relocated building <br />as a triplex rather than as a duplex as stipplated in Condition 6 <br />of VA 67-6 at 5007 West Fifth Street, Santa Ana, California, in an <br />R-1 District; and <br /> <br /> WHEREAS, Appeal Application No. 214 was filed by the <br />applicant appealing the decision of the Zoning Administrator and <br />presenting the matter to the City Council; and <br /> <br /> W}{EREAS, the City Council, after public hearing on notice, <br />has determined that said Variance Application meets the requirements <br />of Section 9250.8 of the Santa Aha Municipal Code and that said <br />Variance should be granted subject to conditions imposed in the <br />granting of Variance 67-6 and other applicable conditions; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Aha does hereby grant a variance on Variance Application <br />68-82, filed by GLEN C. J. FREESE to permit three dwellings in <br />addition to two existing dwellings on an R-1 lot located at 5007 West <br />Fifth Street, Santa Ana, california; said Variance is granted subject <br />to the following conditions: <br /> <br />1. That development be according to the approved plot plan except <br /> for minor modifications approved by the Planning Department. <br /> <br />2. That the parking be according to City standards. <br /> <br />That a full landscape plan be submitted to and approved by the <br /> Planning Department; all approved landscaping shall be <br /> planted and maintained. <br /> <br />4. That the move-in structure be placed three (3) feet more to the <br /> east than shown on the plot plan. <br /> <br />5. That paving be completed between existing house and garage at <br /> 5005 West Fifth Street. <br /> <br />THE FOLLOWING CONDITION IS TO BE COMPLIED WITH PRIOR TO THE ISSUANCE <br />OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: <br /> <br />That the owner place curb, gutter, and sidewalk and pave up to <br /> the edge of existing pavement on Fifth and Sixth Streets. <br /> The new curb and gutter to be placed 18 feet north of the <br /> center lines of said streets. Note: city Plan No. 1-11-16 can <br /> be used. <br /> <br />NOTE: <br /> <br />In the event it is determined by the Director of Public Works <br />that improvement is not feasible at this time, a cash bond or <br />cash must be submitted in lieu of said improvements. <br /> <br />Ana at <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />PASSED AND ADOPTED by the City Council of the City of Santa <br />its regular meeting held on the 7th day of October, 1968. <br /> <br />-1- <br /> <br /> <br />
