RESOLUTION 69-28 AUTHORIZING THE EXCHANGE OF PROPERTIES
<br />BETWEEN THE CITY AND MANUEL AND DOLORES ESQUEDAWHICH
<br />INVOLVES PROPERTY ON THE NORTH SIDE OF FIRST STREET,
<br />WEST OF OLIVE STREET, RESULTING IN A CASH CONSIDERATION
<br />OF $1,535 DUE TO THE CITY
<br />
<br /> WHEREAS, MANI/EL ESQUEDA and DOLORES ESQUEDA, husband and wife,
<br />have executed a deed dated October 17, 1968, conveying to the City
<br />of Santa Ana a parcel of real property on the North side of First
<br />Street, 130 feet West of Olive Street, for a cash consideration of
<br />$6,600; in exchange for which the City will convey to the said
<br />MANUEL ESQUEDA and DOLORES ESQUEDA, husband and wife, as joint
<br />tenants, other real property which has been declared surplus and is
<br />adjacent to the real property being conveyed to the City, which
<br />adjacent property has a cash value of $8,135; the sale of this property
<br />was authorized by the City Council on
<br />
<br /> WHEREAS, MANUEL ESQUEDA and DOLORES ESQUEDA have agreed to
<br />pay to the City of Santa Ana the difference in equity of the interest
<br />in real property being exchanged hereby in the amount of $1,535; and
<br />
<br /> WHEREAS, said transaction is to be handled through Escrow
<br />Number 55932-C with Security Title Insurance Company, Santa Ana,
<br />California;
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana
<br />accepts said deed from MANUEL ESQUEDA and DOLORES ESQUEDA granting
<br />to the City of Santa Ana the following described property:
<br />
<br />The South 40 feet of Lot 9, Block "B" of Hutchins Subdivision,
<br />in the City of Santa Ana, County of Orange, State of California,
<br />as per map thereof recorded in Book 3, Page 18, of Miscellaneous
<br />Maps, Records of said Orange County,
<br />
<br />and Carl J. Thornton, the City's designated agent, is directed to
<br />place his Certificate of Acceptance on said deed;
<br />
<br /> BE IT FURTHER RESOLVED: That the Mayor and the Clerk of the
<br />Council are hereby authorized and directed to execute a deed for
<br />and on behalf of the City of Santa Ana granting to MANUEL ESQUEDA
<br />and DOLORES ESQUEDA that certain real property in the City of Santa
<br />Ana, ~County of Orange, State of California, described as:
<br />
<br />The West 43 1/2 feet of Lot 10 in Block "B" of Hutchins Sub-
<br />division, in the City of Santa Ana, County of Orange, State of
<br />California, as per map thereof recorded in Book 3, Page 18 of
<br />Miscellaneous Maps. records of said Orange County.
<br />
<br />EXCEPTING THEREFROM the South 40 feet thereof.
<br />
<br />ALSO EXCEPTING THEREFROM all oil, gas, minerals and other hydro-
<br />carbon substances in and under said land, lying below a depth of
<br />500 feet from the surface thereof, but without the right of
<br />surface entry, as reserved in the Deed from William E. Vazzana,
<br />et ux., to the City of Santa Ana, recorded September 8, 1967 in
<br />Book 8366 page 775, Official Records of Orange County,
<br />
<br />and deliver the same into Escrow No. 55932-C with Security Title
<br />Insurance Company.
<br />
<br /> PASSED AND ADOPTED by the City Council of the City of Santa
<br /> Ana at its regular meeting held on the 17th day of Feb~~/~
