RESOLUTION 69-146 AUTHORIZING THE EXCHANGE OF
<br />EASEMENTS BETWEEN THE CITY AiqD LESTER AND VIVIAN
<br />ELBERT, ET AL., WHICH INVOLVES PROPERTY ON THE
<br />NORTH SIDE OF McFADDEN AVENUE, WEST OF SULLIVAN,
<br />RESULTING IN NO CASH CONSIDERATION
<br />
<br /> WHEREAS, the parties hereto mutually desire to create
<br />community easements for mutual ingress to and egress from their
<br />respective properties;
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED: That the City of Santa Ana
<br />hereby accepts a deed from LESTER ELBERT and VIVIAN ELBERT, husband
<br />and wife; SIDNEY PENN and BARBARA PENN, husband and wife; and ERNEST
<br />ROSS and DELORACE ROSS, husband and wife, conveying to the city the
<br />real property in the city of Santa Ana, County of Orange, State of
<br />california, described as follows:

<br />An easement for ingress and egress to and from the land hereinafter
<br />described as PARCEL Z over the Westerly 15.00 feet~f the Easterly
<br />168 feet of the Northerly 150.00 feet of the Southerly 192.00
<br />feet of those portions of Lots 38, 39, and 40 of Map of Replat of
<br />Santa Ana Acres, as shown on a map recorded in Book 5, Page 8 of
<br />Miscellaneous Maps, records of Orange County, california,
<br />described as follows:

<br />Beginning at a point on-the center line of McFadden Avenue distant
<br />South 89° 22' 58" West, 721.17 feet from the intersection of the
<br />center line of Sullivan Street and the center line of McFadden
<br />Avenue, as shown on the Map of Tract No. 4025, recorded in Book
<br />146, Pages 46 through 50 of Miscellaneous Maps, records of Orange
<br />County california; thence North 0~ 46' 50" West a distance of
<br />192.00 feet to a point on a line parallel with and distant 192.00
<br />feet Northerly, measured at right angles from said center line
<br />of McFadden Avenue; thence North 89° 22' 58" East a distance of
<br />153 feet to the West line of the land described in the deed to
<br />Lands and Buildings, Inc., recorded April 10, 1962 in Book 6069,
<br />Page 645 of Official Records; thence North 0° 46' 50" West a
<br />distance of 268.00 feet to a point on a line parallel with and
<br />distant 460.00 feet Northerly, measured at right angles, from said
<br />center line of McFadden Avenue; thence South 89° 22' 58" West a
<br />distance of 423.71 feet to a point on a line parallel with and
<br />distant 423.71 feet Westerly, measured at right angles, from said
<br />West line of Lands and Buildings Inc.; thence South 0° 46' 50"
<br />East a distance of 268.00 feet to a point on a line parallel with
<br />and distant 192.00 feet Northerly, measured at right angles, from
<br />'the center line of said McFadden Avenue; thence North 89° 22' 50"
<br />East a distance of 77.08 feet to a point on a line parallel with
<br />and distant 346.65 feet Westerly, measured at right angles, from
<br />said West line of Lands and Buildings Inc.; thence South 0° 46' 50"
<br />East a distance of 192.00 feet to said center line of McFadden
<br />Avenue; thence along said center line, North 89° 22' 58" East,
<br />to the TRUE POINT OF BEGINNING;

<br /> BE IT FURTHER RESOLVED: That the Mayor and the Clerk of the
<br />Council are hereby authorized and directed to execute a deed for and
<br />on behalf of the City quitclaiming to LESTER ELBERT and VIVIAN ELBERT,
<br />husband and wife; SIDNEY PENN and BARBARA PENN, husband and wife;
<br />and ERNEST ROSS and DELORACE ROSS, husband and wife, and to their
<br />successors or assigns, the real ~roperty in the city of Santa Ana,
<br />County of Orange, State of california, described as follows:

<br />An easement for ingress and egress to and from the land herein
<br />after described as Parcel Z over the Westerly 10.00 feet of the
<br />Easterly 153.00 feet of the Northerly 150.00 feet of the Southerly
<br />192.00 feet of those portions of Lots 38 and 39 of map of replat
<br />of Santa Ana Acres, as per map recorded in Book 5, Page 8 of
<br />Miscellaneous Maps, in the office of the County Recorder of said
<br />County, described as follows:
